No. 3. WHEREAS, on December 8, 1987, the electorate of said District and proposed annexation 1 voted to include portions of Sections 9 and 10, Township 39 North, Range 3 East, W.M. into said District. WHEREAS, on July 20, 1988, the duly elected Commissioners accepted a peti- tion for annexation signed by 51- percent of the land owners in the proposed annexation to include portions of Sections 9, 17 and 18, Township 39 North, Range 3 East, W.M., into said District. WHEREAS, the duly elected commissioners of D.D. 3, on October 1, 1985, passed a resolution, pursuant to Charter 396, Section 15 through 18, requesting the County Engineer establish a new system of assessments for said District. WHEREAS, it is deemed advisable by the Whatcom County Council to set aside said assessment as adjudicated on April 21, 1914, and authorize the preparation of a reassessment of property within the boundaries of said D.D. No. 3, including these newly annexed properties. NOW, THEREFORE, BE IT ORDAINED by the County Council of Whatcom County, Washington, as follows: Section 1. The original assessment for Drainage District No. 3 shall be, and is ere y set aside and a reassessment of all property within said District is hereby ordered; such assessment shall be prepared by the Whatcom County Engineer and assessment shall be made by the benefit assessment method, as pro- vided for in RCW 85.38.160. Section 2. The County Council hereby finds and determines that the 1989 assessment roTT for D.D. No. 3 is just and equitable, and that no assessment .against property within D.D. No. 3 is greater than the special benefits to be derived from the improvements. Accordingly, the 1989 annual assessment roll, and the assessments set forth therein are hereby levied against each lot, tract and parcel of property described in said roll. Section 3. January 5, 1989 at 7 :00 p.m., in the Whatcom County Council Chambers in a Courthouse, Bellingham, Washington, is hereby fixed as the time and place for hearing upon the schedule of reassessment. Section 4. That notice of such hearing has been published two times in the newspaper of general circulation in the District, according to R.C.W. 85.38.160, and by mailing a notice to each property owner whose name appears on said assessment roll, indicating the amount of assessment on the lot or parcel that, together with all other assessments in the system, would raise one 340/88 1 2 3 4 5 6 7 8 9 10 11 12 13. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 thousand dollars and that this assessment is not being imposed but is a hypothe- tical assessment given the preliminary system established by the County Engineer. The notice includes a relative comparison between the current year's assessment and the proposed assessment. Henken, County Engineer 01 SUBJECT: Ordinance for.the Reassessment of Drainage District No. 3 and its newly annexed area The Engineering staff has prepared a preliminary schedule of assessments for the benefit of Drainage District No. 3. Two major events precipitated this eva- luation. In 1985, the legislature brought into law Chapter 396, allowing drainage districts to continue to operate under their old assessment methods or to pass a resolution requesting the County Engineer to prepare a preliminary system of assessments, as provided in Section 17 of the new law. Pursuant to this legislation, the Commissioners of D.D. No. 3 passed a resolution requesting the Engineers undertake a reassessment of their District. The second event which necessitated the,reassessment of D.D. No. 3 was the inclusion of almost an additional 1,000-;.acres of new property into the District in mid 1988. After a careful analysis of the factors which contribute to the special benefit of each property in the District, a preliminary system of assessments has been for- mulated. This system is herewith attached, along with an ordinance approving the reassessment. As provided for in RCW 85 -38 -160, notice of a public hearing has been advertised for two weeks beginning on Wednesday, December 14th. Again, as delineated in RCW 85 -38 -160, the hearing can be scheduled no sooner than 14 days and no later than 21 days after the approval of the second notice. Due to this time frame, the hearing has been scheduled on the first regular Council meeting of 1989, which falls on January 5th.
