INTRODUCTION DATE: 9 -25 -90 1 EMERGENCY ORDINANCE NO. 90 -93 2 AMENDING WHATCOM COUNTY CODE, CHAPTER 17 ENTITLED 3 "FLOOD DAMAGE PREVENTION" FOR THE PURPOSE OF 4 INCORPORATING NEW FEDERAL FLOOD MAPS AS REQUIRED 5 BY THE NATIONAL FLOOD INSURANCE PROGRAM 6 WHEREAS, in 1977, Whatcom County enacted a flood damage prevention 7 ordinance pursuant to federal requirements for community participation in the National 8 Flood Insurance Program; and 9 WHEREAS, in 1987, Whatcom County amended said ordinance in accordance 10 with mandatory federal guidelines; and 11 WHEREAS, at the time of its enactment and amendment, the Ordinance was in 12 compliance with mandatory federal guidelines under the National Flood Insurance 13 Program for local flood damage prevention legislation; and 14 WHEREAS, the federal government is adopting an additional flood insurance 15 rate map, including accompanying report dated September 28, 1990; and 16 WHEREAS, participation in the National Flood Insurance Program provides a 17 direct benefit to the community by malting flood insurance available at reasonable cost 18 and participation in the National Flood Insurance program is a prerequisite for the use 19 of federal funds for projects in the flood plain. 20 WHEREAS, unless this ordinance is effective on September 28, 1990, the Federal 21 Government will terminate the authority to approve Veteran's Administration loans, 22 Federal Housing Authority loans, and Farmer's Home Administration. This ordinance 23 requires a hearing; there is not enough time between now and September 28 to schedule 24 a public hearing. 25 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that 26 Whatcom County Code, Chapter 17.04.050 be amended as follows: 27 17.04.050 Basis for establishing_ areas of special flood hazard. The areas of 28 special flood hazard identified by the Federal Insurance Administration are contained in 29 a scientific and engineering report entitled 'The Flood Insurance Study for the County of 30 Whatcom, Washington" (effective date Sept. 30, 1977). The accompanying Flood Page 1 1 Insurance Rate Maps, dated Sept. 30, 1977 and Sept. 28. 1990 including accompanying 2 reports and any subsequent amendments made by the Federal Emergency Management 3 Agency, are adopted by reference and declared to be a part of this title. The flood 4 insurance study is on file at the Department of Public Works. (Ord. dated 9./23/77 Sec. 5 3.2). 6 BE IT FURTHER ORDAINED THAT: 7 1. Unless specifically amended by this ordinance, all other 8 provisions of the flood damage prevention ordinance, 9 Chapter 17, shall remain the same. 10 2. The Council finds the public health, safety and general 11 welfare are promoted by the above change. 12 3.
