ZONING ORDINANCE, TITLE 20, TO MODIFY SECTIONS 20.80 SUPPLEMENTARY REQUIREMENTS,
20.64.600 AND 20.65.606 RESORT COMMERCIAL AND GATEWAY INDUSTRIAL SIGN
REGULATIONS, AND 20.97 DEFINITIONS, TO INCLUDE ADDITIONAL RESTRICTIONS ON OFF -

SUMMARY STATEMENT: Because of the controversy associated with the sign regulations, the
lack of public participation at the Planning Commission hearing, the Council's possible
desires to make changes, the minority report, and some minor adjustments the staff would liek
to request, it is recommended that Council hold its own hearing on the proposed sign
regulation revisions.
RECOMMENDED ACTION: The Planning Commission recommends adoption of the proposed ordinance.
Staff recommends an additional hearing.

11 WHEREAS, the Whatcom County Planning Department has initiated proposed
12 modifications to the Official Whatcom County Zoning Ordinance, Title 20, to modify
13 sections 20.80 Supplementary Requirements, 20.64.600 and 20.65.606 Resort
14 Commercial and Gateway Industrial sign regulations and 20.97 Definitions, to include
15 additional restrictions on off - premise advertising signs; and
16 WHEREAS, pursuant to RCW 36.70.590 and Council directive legal notice was
17 published in the Westside Record Journal and the Lynden Tribune on March 7, 1990;
18 and in the Bellingham Herald on March 10, 1990; and
19 WHEREAS, a Determination of Non Significance was issued by the Deputy
20 SEPA Official on April 23, 1990; and
21 WHEREAS, the Planning Commission held a public hearing on this matter on
22 March 20, and two work sessions on March 28 and April 17, 1990; and
23 WHEREAS, after accepting public testimony and due deliberation the Planning
24 Commission made minor modifications to the proposed amendments and accepted the
25 staff findings and conclusions and voted 6 -3 in favor to recommend approval to
26 Council the requested text change as modified by the Commission;
27 WHEREAS, the Council, at a public meeting on May 8, 1990, and following a
28 public hearing on July 10, 1990, reviewed and approved the Planning Commission
29 recommendations.
30 NOW THEREFORE BE IT ORDAINED by the Whatcom County Council as
31 follows:
32 1. The Official Whatcom County Zoning Ordinance, Title 20, is hereby amended
33 as follows:

3 Official Whatcom County Zoning Ordinance. except that no off premise

3 2. The Council finds the public health, safety and general welfare are promoted
4 by the above change.
5 3. The Council adopts the following findings and conclusions as developed by -staff
6 and approved by the Planning dommission- . and attached in exhibit "A".
7 4. Adjudication of invalidity of any of the sections, clauses, or provisions of
8 this ordinance shall not affect or impair the validity of the ordinance as
9 a whole or any part thereof other than the part so declared to be
10 invalid.
