Yes /_/ No /LV SUMMARY STATEMENT- Director of Developmental Disabilities Carl Allen requested that this section of the County Code be revised to add language creating the DO Department. The Department has existed for a number of years, but its establishment never has been formalized in the Code. Recently, questions- have arisen about the role of the Advisory Board and in order to clarify those matters and others, this amendment to the Code is being proposed. Director appointment. Department staff. Developmental Disabilities Advisory Board created. Services. Cooperation with other entities. Open meeting Act. Contracts. Fund establishment. Severability. 2.85.010 Department established. There is established the Department of Developmental Disabilities, hereinafter referred to as the "Department," an executive department of the county. The Department shall continue as in place as to staff and programs upon the effective date of this Ordinance. 2.85.020 Director appointment. A. The county executive shall appoint the chief executive officer, hereinafter referred to as the "director" of the Department, subject to confirmation by a majority of the county council. the director shall be the county's developmental disabilities coordinator, in accordance with the provisions of RCW 71A.12 and RCW 71A.14. B. The director will be appointed to an indefinite term and will serve at the will of the county executive. 2.85.030 Department staff. It is the responsibility of the director to hire the Department staff in accordance with the personnel policies and procedures of the county and any other applicable laws and regulations. 2.85.040 Developmental Disabilities Advisory Board. A. The Whatcom County Developmental Disabilities Advisory Board, hereinafter referred to as the "Developmental Disabilities Board," is created and shall serve in an advisory capacity to the Department of Developmental Disabilities services on all issues related to the county Developmental Disabilities program and in accordance with RCW 71A.12 and RCW 71A.14. B. The Developmental Disabilities Board shall consist of fifteen members who are residents of Whatcom County. Fourteen members of the board shall be appointed by the county executive subject to confirmation by the majority of the county council and DD.ORD, DRAFT 6/8/90, Page 2 1 shall include but not be limited to representatives of public, 2 private, or voluntary agencies, representatives of local govern - 3 mental units, and citizens knowledgeable about developmental 4 disabilities or interested in services to persons with develop - 5 mental disabilities in the community. One member shall be 6 appointed by the County Council. The term of office for the 7 members appointed by the executive shall be for three years. The 8 term of office for the member appointed by the county council shall 9 be for one year, from the time of the council's reorganization 0 meeting to the next such meeting the following year. 1 C. The Developmental Disabilities Advisory Board shall 2 continue as to members, terms of office, officers, and rules of 3 procedure for conduct of their business in place on the effective 4 date of this Ordinance. 2.85.050 Services. The Department, with the advice of the boards, shall prepare, solicit and evaluate proposals from potential service providers to provide developmental disabilities services within the county. Following the evaluation of such proposals, the Department shall file a recommendation with the county executive for action in accordance with state and county regulations. 23 24 2.85.060 Cooperation with other entities. Subject to the 25 administrative and legislative control of the County Executive and 26 the County Council, the Department may cooperate and enter into 27 contracts with, and receive moneys from, public and private :8 entities to carry out services set forth in this Chapter. 29 30 2.85.070 Open meetings act. The Developmental Disabilities 31 Board meetings shall be subject to the Open Meetings Act, RCW 32 Chapter 42.30 et. seq. 33 34 2.85.080 Contracts. All contracts, agreements, rights, 35 claims and obligations, either in favor of or against the Whatcom 36 County Department of Developmental Disabilities at the time the 37 ordinance codified in this chapter takes effect, shall continue in 38 full force and effect, and responsibility therefore shall be 39 transferred to the Whatcom County Department of Developmental 40 Disabilities. 41 42 2.85.090 Fund estabishment. The Developmental Disabilities 43 Fund is hereby, established as a special revenue fund. The Fund 44 shall be used exclusively for the financing of Developmental 45 Disabilities services provided for herein. 46 47 2.85100 Severability. It is understood and agreed to by the 48 parties hereto that if any part of this Agreement is illegal, the 49 validity of the remaining provisions shall not be affected and the 50 51 52 DD.ORD, DRAFT 6/8/90, Page 3 1 rights and obligations of the parties shall be construed as if the 2 Agreement did not contain the particular illegal part. If it 3 should appear that any provision hereof is in conflict with any 4 statutory provision of the State of Washington, said provision 5 shall be deemed inoperative and null and void insofar as they may 6 be in conflict therewith, and shall be modified to conform to such 7 statutory provision. 8 9 10 11 DD.ORD, DRAFT 6/8/90, Page 4
