The Health Board Advisory Committee recommended the changes be made as indicated in
Exhibit A of the ordinance. The intent is to clarify the role of the HBAC in
setting the budget for the Health Department, as a mecha6ism for cities using the
Health Department's services to have some say in the budget process.

5 AMENDING TITLE 24.01 TO REFINE THE DUTIES AND
6 POWERS OF THE HEALTH BOARD AND ITS ADVISORY COMMITTEE
7 WHEREAS, the Health Board Advisory Committee includes representatives of
8 Bellingham's City Council, the smaller cities in Whatcom County, and the unincorporated
9 areas; and
10 WHEREAS, the Bellingham City Council, the smaller cities of Whatcom County
11 and the unincorporated areas all have an interest in determining the budget for the
12 County Health Department; and
13 WHEREAS, present language in Title 24.01 does not clarify the role of the Health
14 Board Advisory Committee in setting the budget for the Health Department; and
15 WHEREAS, the Health Board Advisory Committee recommends that Title 24.01
16 be amended as indicated in Exhibit A of this ordinance;
17 NOW, THEREFORE, BE IT ORDAINED BY THE Whatcom County Council
18 that changes be made to Title 24.01 as indicated in Exhibit A of this ordinance.

3 The indicated changes shall be made to Title 24.01:
4 24.01.060 - Powers and Duties of Health Board.
5 The Whatcom County Council in its capacity as Health Board shall have the following
6 legislative powers, in accordance with RCW 70.05.060, and other legislative duties that
7 may be established by state or county law.
8 A. Enact such local rules and regulations as are necessary in order to
9 preserve, promote, and improve the public health and provide for the
10 enforcement thereof.
11 B. Establish fee schedules for issuing or renewing licenses or permits
12 . for such services as are authorized by the law and the rules and regulations

15 of providing any such services.

C. Meet from time to time with representatives of the cities with which
the department may contract to review performance and service provision.
D. Make recommendations to the Executive on matters affecting public
health.
24.01.080 - Contracts for the sale of health services.
1. 1.
After 1989, in accordance with RCW 70.10.150, the Department shall
cooperate with and enter into contracts or interlocal agreements with the
cities in the county to provide those cities'' health services, which may
include enforcing appropriate city ordinances as has been done in the past.
The contracts shall be on such terms and under such conditions as the
