SUMMARY STATEMENT*
The Council is having a hearing on new demolition landfill regulations; if final action
is taken to adopt the regulations at the 6/5 meeting, the regulations will not take effect
until 6/16. The emergency moratorium on demolition landfill permits established by
Ordinance 90 -32 on April 10 expires June 11. This emergency ordinance would cover the
gap between June'll and June 16, or longer if necessary, until the regulations are
in place.
RECOMMENDED ACTION.-
Council Staff recommends that the emergency ordinance be adopted.

EMERGENCY ORDINANCE EXTENDING THE MORATORIUM
ON THE DEMOLITION LANDFILL PERMITS
WHEREAS, the Whatcom County Council will have a public hearing on new
demolition landfill regulations on June 5, 1990, possibly taking final action to adopt
the regulations at that time; and
WHEREAS, if adopted June 5, the regulations will take effect on June 16,
1990; however, the emergency moratorium on demolition landfill permit applications,
imposed by Council ordinance. 90 -32 on April 10, 1990, expires. on June 11, 1990; and
WHEREAS, existing regulatory requirements do not provide for adequate
health department assessment to assure permitting will protect the health of the
public; and
WHEREAS, the lack of existing, adequate regulations could result in the
inability of the Health Department to prevent long -term health costs to the County,
inadequate design standards and operational plans, and possible uncontrolled dump
sites; and
. WHEREAS, for the reasons cited herein and in Ordinance 90 -32, the
moratorium still is necessary to protect the public's health, safety and welfare;
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council
that a moratorium on the granting of permits for demolition landfills by the Health
Department is hereby extended from the end of the moratorium imposed under
Ordinance 90 -32, until such time as new County regulations are adopted and in place,
provided that the moratorium shall not exceed the legal time limit allowed under the
Whatcom County Charter.
