SUBJECT. AN ORDINANCE EXTENDING THE MORATORIUM ON PROCESSING CONDITIONAL USE APPLICATIONS
FOR OFF PREMISE ADVERTISING SIGNS FROM APRIL 30, 1990 TO JUNE 30, 1990.

SUMMARY STATEMENT: The proposed amendments on sign regulations has been delayed at the
Planning Commission level because of their controversial nature and the necessity to get a
majority vote. The Commission will consider the amendments again on April 17th and should
be able to move them forward at that time. Council may also wish to have its own hearing
given the nature of the amendments.
The present moratorium will be up on April 30, 1990 and needs to be formally extended if
that is the desire of Council. If Council wants to insure that there is no lapse at all in
the moratorium, an emergency ordinance also needs to be passed on April 24th.
RECOMMENDED ACTION: Planning staff recommends the moratorium be extended until at least June
30, 1990 by passage of both the extension ordinance and the emergency ordinance.. The latter
is less important but insures full protection.

AN EMERGENCY ORDINANCE EXTENDING THE MORATORIUM ON PROCESSING
CONDITIONAL USE APPLICATIONS FOR OFF - PREMISE ADVERTISING SIGNS FROM APRIL
30, 1990 TO May 4, 1990
WHEREAS, by Ordinance 89 -94 the Whatcom County Council established a moratorium on processing
conditional use applications for off - premise advertising signs to April 30, 1990; and
WHEREAS, the Planning staff has completed an analysis of the current situation in Whatcom County,
reviewed other pertinent regulations and prepared a staff report for the Planning Commission recommending
revisions to the regulations; and
WHEREAS, on March 20, the Planning Commission held a public hearing on the proposed revisions to the
sign regulations; and
WHEREAS, the Planning Commission held a subsequent work session on March 28, 1990, and developed
a recommendation but failed to achieve five affirmative votes (7 members present, 4 -3 in favor); and
WHEREAS, this item will be considered again at the regular Planning Commission meeting of April 17,
1990; and
WHEREAS, because of the nature of these regulations Council may desire to hold its own hearing.
NOW, THEREFORE BE IT ORDAINED BY THE WHATCOM COUNTY COUNCIL:
1. The moratorium on off - premise advertising signs imposed by Ordinance 89 -94 is hereby continued from
April 30 to May 4, - 1990.
2. The Council finds the public health, safety and general welfare are promoted by the above change.
3. Adjudication of invalidity of any of the sections, clauses, or provisions of this Ordinance shall not affect or
impair the validity of the Ordinance as a whole or any part thereof other than the part so declared to be
invalid.
