SUMMARY STATEMENT: This text amendment increases the square footage allowed for individual
Tourist Commercial type retail uses from 2500 square feet maxiumum to 35,000 square feet in
the area of the Gateway Industrial zone near the I -5 interchange. The purpose is to allow
a factory outlet shopping complex in this area.
RECOMMENDED ACTION: Planning Commission recommendation for adoption of ordinance. Staff
recommendation is to remand or hold a hearing.

AN ORDINANCE AMENDING THE TEXT OF THE OFFICIAL WHATCOM COUNTY ZONING
ORDINANCE, GATEWAY INDUSTRIAL DISTRICT (WCC 20.65) TO ALLOW TOURIST
COMMERCIAL RETAIL SHOPS UP TO BUT NOT TO EXCEED 35,000 SQUARE FEET WITHIN
ONE QUARTER MILE OF A FULL FREEWAY INTERCHANGE
WHEREAS, Zan Marquis, represented by Philip Serka, has requested that the text
of the Official Whatcom County Zoning Ordinance, Gateway Industrial District (WCC
20.65) be amended to allow one half of the retail shops in the Tourist Commercial
portion of the Gateway Industrial zone district to exceed 5,000 square feet in area;
and
WHEREAS, pursuant to RCW 36.70.590 and Council directive legal notice was
published in the Westside Record Journal and Lynden Tribune on Wednesday, January 3,
1990, and in the Bellingham Herald on Saturday, January 6, 1990; and
WHEREAS, a Determination of Nonsignificance was issued by the Deputy SEPA
Official on December 13, 1989; and
WHEREAS, the Planning Commission held a public hearing on this matter on January
16, 1990, and heard all public testimony on the issues and after due deliberation made
a determination that the application be approved with modifications; and
WHEREAS, the Council reviewed the Planning Commission recommendation and held
a public hearing on April 10, 1990, to take additional testimony.
NOW THEREFORE BE IT ORDAINED BY THE WHATCOM COUNTY COUNCIL:
1. Title 20 is hereby amended as follows:
MODIFY WCC 20.65.055 TO READ:
Tourist Commercial uses listed in Section 20.63.050 through .60, 20.63.101, and
20.63.151 through .154, within 1/4 mile of a full freeway interchange, except
that where this boundary divides a single parcel up to ten percent (10 %) of the
area of a parcel that lies outside of this boundary may be included within it
for the purposes of lot coverage and open space provisions. Retail shops listed
herein shall be permitted up to but not to exceed 35.000 square feet Der retail
shop.
2. The Council finds the public health, safety and general welfare are promoted by
this change.
3. The Council adopts the findings and conclusions in the attached Exhibit "A" as
adopted by the Planning Commission.
4. Adjudication of invalidity of any of the sections, clauses, or provisions of
this Ordinance shall not affect or impair the validity of the Ordinance as a
whole or any part thereof other than the part so declared to be invalid.
