lands and except.for those parcels .determined to have vested rights.This shall be in

2 AN EMERGENCY INTERIM ZONING ORDINANCE PLACING A MORATORIUM ON
3 SURFACING MINING IN WHATCOM COUNTY

5 WHEREAS,the Official Zoning Ordinance,Title 20,and the Interim Zoning
6 Ordinance,WCC Chapter 2.24A,have regulations related to surface mining;and
7 WHEREAS,based on a number of concerns regarding the existing regulations,the
8 Whatcom County Council directed the Planning staff and the Planning Commission to
9 review and propose revisions to these regulations;and
10 WHEREAS,the Planning Commission held a public hearing on proposed revisions on
11 July 17,1990,and heard all testimony on the issues;and
12 WHEREAS,the Planning Commission discussed the proposal at seven additional
13 meetings on September 11,October 8 and 16,and November 6,14,and 27,and after due
14 deliberation made a determination that the application be approved with revisions by
15 the Planning Commission and staff;and
16 WHEREAS,the Council received the Planning Commission recommendations and based
17 on their controversial nature,determined to hold its own hearing on five aspects of
18 the proposed regulations;and
19 WHEREAS,subsequent to the Planning Commission's final action,it came to the
j County's attention that State legislation may preempt local regulations regarding
21 surface mining;and
22 WHEREAS,the Deputy Prosecutor has determined that the 1egi sl ature has preempted
23 local regulations and that the County's proposed regulations probably would not stand
24 up to legal challenge;and
25 WHEREAS,based on the above determi nat ion,the Council canceled the pub 1ic
26 hearing on aspects of the proposed surface mining regulations;and
27 WHEREAS,SHB 2929,the Growth Management Act,reestablished a regulatory role
28 for local government in forestry,mineral resources,agricultural lands,and critical
29 areas;and .
30 WHEREAS,in Whatcom County there is the potential for major conflict between
31 these valuable resources,particularly agricultural and mineral resource lands as a
32 surface mine could preclude the re-use of land for agricultural production;and
33 WHEREAS,surface mining in some locations may also be inconsistent with the
34 mandate to protect aquifer recharge areas;and
35 WHEREAS,the Growth Management Act requires that Counties designate and regul ate
36 on an interim basis,critical areas and natural resource areas by September 1,1991;
37 and
~WHEREAS,Whatcom County has significant agricultural and forestry zoning in
J9 place now to qualify for the interim designation and regulations of these resources,

1 leaving only mineral resources to be considered;and
2 WHEREAS,Whatcom County has recently done an extensive inventory of eXisting
3 mineral resource operations,including clay,sand,gravel,rock,and shale
4 excavations,which is required by the Growth Management Act;and
5 WHEREAS,Whatcom County is likely to designate the aforementioned lands as
6 mineral resource lands under the Growth Management Act;and
7 WHEREAS,Whatcom County is currently moving forward with formally adopting
8 designations and interim regulations for agricultural,forestry,mineral resource
9 lands,and critical areas;and
10 WHEREAS,substantial time will pass prior to adoption of such designations and
11 interim regulations during which the designation process may be thwarted by a flood
12 of applications for surface mining conditional use permits;and
13 WHEREAS,currently,there are a total of approximately 275 acres being surface
14 mined in the agricultural zone;and
15 WHEREAS,since March 11,1991,four surface mining conditional use applications
16 have been received,including three in the agricultural zone,totalling 487 acres;and
17 WHEREAS,the Division of Buildings and Code Administration is processing several
18 permits now;and
19 WHEREAS,extensive inquiries have been made regarding additional applications;
20 and
1 WHEREAS,the accumulation of these surface mining applications in the
22 Agricultural Zone could impact the agricultural resource.
23 The above paragraphs represent findings of fact by the Whatcom County Council.
24 Based upon these findings of fact,it is hereby declared that enactment of this
25 emergency ordinance is necessary for the immediate preservation of the public peace,
26 health and safety.
27 NOW THEREFORE TO PRESERVE THE INTEGRITY OF THE PROCESS AND DIRECTIVES MANDATED
28 BY THE GROWTH MANAGEMENT ACT,IT IS HEREBY ORDAINED THAT:

rights.
This moratorium shall be in effect for 60 days.
