10 AN ORDINANCE AUTHORIZING THE LEW OF TAXES
11 FOR COUNTY AND STATE PURPOSES
12 IN WHATCOM COUNTY, WASHINGTON,
13 FOR THE YEAR OF 1994
14 PVRSUANT TO HOME RULE CHARTER SECTION 6.14

16 WHEREAS, pursuant to Home Rule Charter Section 6.10 the County Executive is
1.7 required to submit for Council consideration proposed tax and revenue ordinances necessary to
18 raise sufficient revenues to balance the Budget; and,
19
20 WHEREAS, at this time this matter corning on regularly for consideration by the Council,
21 and the %vy for the State taxes as hereinafter male Ming in accordance with the notice as given
22 by the State Board of Equalization and the State Auditor in the manner provided by law; and,
23
24 WHEREAS, the County taxes having been can estimates filed in accordance with Home
25 Rule Charter 6.20; and,
26
27 WHEREAS, the port of Bellingham taxes being in accordance with the Resolution of the
28 Board of Dort C.ornmissionem of the Port of Bellingham; and,
29
30 WHEREAS$ the taxes of the Whatcom County Fire Protection Districts, Water Disv icts,
31 and Cemetery Districts being in amrdance with requests by the Commissioners of the various
32 districts; and,
33
34 WHEREAS, the School taxes being in accordance with the estimates as furnished by the
35 Directors of the several school districts and by the Chairman of Educational . Services District
36 # 189; and,
37
38 WHEREAS, the estimated receipts from the State and County apportionments of each
39 district being taken into consideration and the levies in the School Districts which exceed the
40 statutory limit being in accordance with elections ratifying and authorizing said levies, and the P.
4: levies for the payment of school bonds and interest being in accordance with the requests and
42 needs of each District as expressed by its Board of Directors; and,
43
44 WHEREAS, this Council having considered the needs of the State, County, Fort, Fire
45 Districts, Cemetery Districts, Water Districts, Hospital Districts, School I, stricts, Cities and
46 Towns, and Drain -age and Drainage Improvement Districts,

I NOW, THEREFORE-, BE IT ORDAINED AND ESTABLISHED by the Whatcom County
2 Council of Whatcorn County, Washington, that there be and heresy are levied taxes of Whatcorn
3 County, Washington, to be charged on the assessment and tax rolls of said County for the year
4 1994, for the respective funds hereinafter designated and the number of dollars hereinafter
5 specified with respect to each of said funds.

BE IT FURTHER ORDAINED, that the taxes to be levied and charged against the taxable
property in Whatcom County, Washington, to cover expenditures in 1994 are to be set at their
highest passible level, with any reductions to be the result of a direct request from the taxing
district; and excepting the County general levy and County road levy which shall be increased, no
more than 4.2 percent over the 1993 collections plus those additional monies collected as a result
of new construction and parcels added to the rolls, this assumed level of assessment being
necessary as the Mate of Washington is unable to provide the figures and documentation
necessary to establish fixed levy rates, and at such time as these figures do become available from
the State, levies shall be .fixed as follows per attached "Exhibit A,," and incorporated herein by
reference notwithstanding the levies fixed herein, the amount collected through the County
general levy shall be reduced by $105,553.26 to reflect and remove an overcollection of the same
amount through the 1972 General Obligation band fund. The amount previously overcollected
shall be transferred to the Current. Expense fund.
BE IT FURTHER, OR- DAMD, that the taxes to t

levies contained herein, and the Prosecuting Attorney's Office concurs, the Whawom County
administration will change such levies a=- rdingly.

understanding that copies of their resolutions regarding their annual levies are to be
sent to your office for inclusion in the County's 1994 Budget. Diking District No. 1
has completed their meeting and finalized their annual assessment. D.I.D. No. 30a
may not have been included in my previous correspondence.

RESOLUTION NO.
1994 APPROVED BUDGET AND SETTING THE
SPECIAL ASSESSMENT
WHEREAS, the Commissioners of the Diking District No. 1 held their annual meeting
and have approved the attached budget for the succeeding year, and
WHEREAS, Section 18 of Chapter 395, Laws of 1985, states "Budgets for each
special district shall be adopted, and special assessments imposed annually for
the succeeding calendar year. "
NOW, THEREFORE, BE IT RESOLVED, that the governing body of this special
district direct a special assessment for 1994 in the amount of $ 1,00 A0^11!� and said
assessment shall be imposed pursuant to the system of assessment established by the
County.

In conforoulty with Section 2.30 of the Whatcom County Home Rule Charter, i am returning
broth ordinances to you with my vet
I am vetoing the two ordinances and voicing my objections to them ,.)gether because I
consider them an integrated package setting out the 1994 financial plan for Whatcom
County. Because I feel this financial plan is unsound, I have vetoed it.
I have been involved in the development of budgets for Whatcom County for fifteen years,
and have adiuinistered budgets £car ten of those years. In that time, I have never seen a
budget plan that is as shaky as this one with such a high potential for triggering a severe
financial and legal crisis for the County, both intermediate and long- term.
I have summarized my concerns, followed by an itemization of the significant issues in the
final budget which have prompted my veto. a

A. Revenue has been reduced in the Current Expense Fund without spending cuts to offset
the lass, This revenue reduction will carry on into succeeding years with ongoing
Implications.
Be Dine additional positions and over a half a million dollars of operational expenses have
been added to the Current Expense Fund. In years following 1994, as the revenue decrease
amount grows, the added spending /staff costs will also grow, widening the gap between the
two each year,
C A Current Expense Fused balance is identified, but It is based can some revenue that is
not there, some revenue that Is unsubstantiated, and some that has a very slim probability
of being received In 1994.
Specific issues of concern in the final 1994 Rudgot are.
1. Revenue for the Current e Fund has been reduced, but there is no offsetting cut
in spending, rather spending is increased in the Fund by over $500,000.

ernploycner *. to a l+evei higher than in 1993, when for two years running, we have been
unable to pay for the level we had.
3. lFu "ding for payment legally required or, Lhe contract for the Courthouse construction
project, and for wont to sheet th r f,, I)VA MM Conditional Use Permit requirements at the
Northwest Annex was eliminated.
4. Three employees from the Equipment Rental and Revolving Fund (RR &R) - Central
Stores, were transferred to the Administrative- Services Department although the position
to supervise them had been eliminated.
5. Nearly $300,000 in money from the Drug Fund is used to pay for permanent, ongoing
staff when there is no history or guarantee that the Fund can be relied on to produce that
amount of money on an ongoing, annual basis.
6. A jail deputy is funded with Road Fund money which, by law, must be used for road or
traffic- related work. Audit findings on this in a future year could jeopardize $500,000 to
$600,000 of state grant money annually received and used for road construction and
improvement.

7. An assumption is made that traffic fine revenue of $100,000 will be received, to be
generated by the two added traffic deputies, Historically this has happened.
8. A 1994 ending fund balance of $930,673 is projected for the Current Expense Fund. In
reality, Qa n what we currently know about projected revenues, that money will not be
there. Larger supplemental budgets than planned for have lowered the 1993 ending fund
bale, the added traffic fine money is unsubstantiated, and no settlement has been made
witl^ the City of Bellingham for criminal justice money.
The Executive's proposed Budget had capital (one�tftne) expenditures in it that could have
been delayed if a settlement were not reached with Bellingham. Also, it had an adequate
fund balance built from krwwn revenue to provide for the supplemental budgets which will
inevitably be requested in 1994,
The Council replaced the capital (one - time) expenditures with permanent staff position,
and other operate

costs and left no assured money for a fund balance,
Unless 1993 closes with a much higher Current Expense Fund balance than projected., or
a settlement is re tied with Bellinghaan on criminal justice funding, there will be no money
to pay a union Ontract settlement for the Sheriff and Jail staff, no money for emergencies,
no money for any supplements to Oirrent Expense departments for unfomseen needs, and
very pos�.ilily not even enough uxtoney to pay the bills for 199" at the level of staffing
adopted by the County Council. Any of these ite= will require budget cuts somewhere
before money can be made availatle for them.
Further, unless there is a major upturn in the economy, and revenues fail exceed projections,
staff cuts will again be required to balance the 1995 budget. They will be made deeper, and
more painful because of the positions added in 1994.
9, The position of Director of Developmental Disabilities was funded for only half a year
when reorganization proposed for human services has not yet been discussed, developed or
adopted. Without a Director, nearly $1 million a year in state grant money for services to
the developmentally disabled is jeopardized.
• 10. Unilaterally reducing the Solid Waste program by $198,262 is in violation of the
lnterlocal Agreement Whatcom County has signed with the seven cities of the County.

CONCLUSION
ne Budget for 1994, as passed by Council, ignores past experience and history regarding
revenue generation and fails to take into account both shortwtenrn and long -term financial
implications. I can only describe it as fiscally irresponsibleo
If the Finance Committee wishes to discuss with me ways to change the Budget to address
some of these cons erns, I am wittizag to do $o.
If instead., the current Council simply overrides these two vetoes, the Council and
administration to 199.4 Twill be faced with very difficult, agor%Wr ng and probably unpopular
decisions and actions, fihc result of such Upheaval will imp act the public to whom we
provide service.
,110 responsibility for the financial problems caused by this irresponsible budget wilt rest
squarely on the shoulders of the Co=' Rmernbers who choose to override these vetoes* They
should each be individually hold accountable by the public for this action.
I urge the 4incil to reconsider the seriorusnoss of
significant raHficatiorts for County operations in 1994.
