WGINATOR'S RECOMMENDED ACTION Recommend approval. 31MMITTEE ACTION TAKEN: )UNCIL ACTION-TAKEN.- 11/9/93: Council /Introduced 11/23/93: Council adopted the ordinance. 5 -1 (Laidlaw abstain) Wed File Numbers: Ordinance or Resolution Number (this item only): Ord 93-079 SPONSORED BY Consent PROPOSED BY PUBLIC WORKS DEPARTMENT INTRODUCTION DATE 11/9/93 ORDINANCE NO. 93 -079 REGARDING FINALIZING THE SYSTEM OF ASSESSMENT FOR DRAINAGE DISTRICT NO. 3 (GREEN LAKE, FOUR -MILE CREEK) WHEREAS, a petition requesting annexation of territory into Drainage District No. 3 was received by the governing body of said district, and WHEREAS, said petition was signed by the owners of a majority of the acreage proposed to be annexed, and WHEREAS, said governing body passed a motion approving said annexation under the direct petition method of RCW 85.38.200 at a special meeting on April 2, 1993 and as amended at a special meeting on May 13, 1993, and WHEREAS, said governing body passed a motion at said special meeting on April 2, 1993 recommending that the owners in the newly annexed area pay 40- percent of the initial ditch cleaning cost of $5,174.40 through their area and the owners of land previously in the District pay the remaining 60- percent, and WHEREAS, a preliminary system of assessment (see attached) has been prepared by the County Engineer, as required by RCW 85.38.160, for Drainage District No. 3, and WHEREAS, a public hearing on said system of assessment has been scheduled for November 23, 1993, NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council as follows: SECTION 1 - The County Council hereby finds and determines that the system of assessment prepared by the County Engineer and /or changed by the County Council is just and equitable and that no assessment against property within Drainage District No. 3 is greater than the benefits to be derived from the improvements.
