T' - Council indicated, on 9/28, that it supported the concept of a dog control zone in the area petitioned for
t, lreg Steinbach, et. al. In order to enact the dog control zone Whatcom County Code Section 6.04 must be
amended by ordinance. A legal description of the proposed zone, based on the description provided by
petitioners, was prepared by the Engineering Division of the Public Works Department.
As an official control, this ordinance requires a hearing prior to its adoption.

3 ESTABLISHING A DOG CONTROL ZONE IN THE
4 MOSQUITO LAKE ROAD AND MOUNT BAKER HIGHWAY AREAS,
5 AMENDING WHATCOM COUNTY CODE SECTION 6.04

7 WHEREAS, at least 50 citizens in the Mosquito Lake Road and Mount Baker
8 Highway areas, represented by Greg Steinbach, petitioned the Council to establish a dog
9 control zone in that area; and

11 WHEREAS, after advertising the Council's intent to review the petition as
12 required by Whatcom County Code 6.04, the Council voted to support the citizens'
13 petition and to have staff draw up an ordinance establishing a dog control zone; and

15 WHEREAS, the area specifically petitioned to be included in the dog control
16 zone was described on the petition as follows: 'Proposed dog control zone to include all
17 homes along Mt. Baker Hwy from address 5556 Mt. Baker Hwy to Coal Cr. Also from
18 the N. Fork of Nooksack R. Westerly to the Mt. Baker Hwy and West or uphill from
9 hwy. a reasonable distance. A fair size buffer area is also desirable." ; and

21 WHEREAS the Engineering Division of the Public Works Department developed
22 from that description an appropriate legal description of the zone and a map showing the
23 boundaries; and

25 WHEREAS, in order to establish this dog control zone the Council must amend
26 Section 6.04 of the Whatcom County Code;
27
28 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
29 a dog control zone is hereby established in the Mosquito Lake Road and Mount Baker
30 Highway areas, more specifically described in Exhibit A to this ordinance; and

BE IT FURTHER ORDAINED that Whatcom County Code Section 6.04 is
hereby amended as indicated in Exhibit A to this ordinance.
ADOPTED this 26th day of October, 1993.
