In the course of re- publishing the Whatcom County Code, Code Publishing Company of Seattle encountered
.e apparent scrivener's errors. Civil Deputy Prosecutor Dan Gibson recommended that some of the
corrections be accomplished by ordinance and formal Code amendment. It is important that the Council
consider adoption of the ordinance as soon as possible.
ORIGINATOR'S RECOMMENDED ACT ION.-
The Clerk recommends adoption of the ordinance by July 27, 1993.

ORDINANCE NO. 93 -047
AMENDING CERTAIN SECTIONS OF THE WHATCOM COUNTY CODE TO
CORRECT SCRIVENER'S ERRORS AND /OR UNCLEAR TEXT AMENDMENTS
WHEREAS, Code Publishing Company has encountered some apparent
scrivener's errors or unclear text amendments . in the course of re- publishing and updating
the Whatcom County Code; and
WHEREAS, Dan Gibson, Civil Deputy Prosecutor, recommends that some of
these corrections and changes require amendments to the existing Code and therefore
they should be enacted by ordinance;
NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
the Whatcom County Code shall be amended as indicated in Exhibit A to this ordinance.

TITLE 10 - VEHICLES AND TRAFFIC
Note. Ordinance 92 -82 determined that the establishment of a speed limit and school zone
in Point Roberts should be codified under sections 10. 04.070 and 10.04.080, when in reality
the text needed to be codified under 10.04.020 and 10.04.095.
10.04.020 Twenty -five miles per hour. The speed limit shall be twenty -five miles

10.04.030 Twenty -five miles per hour. The speed limit shall be twenty -five miles
per hour on the following roads and streets:
POINT ROBERTS ROADS. All roadways on Point Roberts except those
described in Section 10.04.040 AMMM.
10.04.095 School zones. A. School zones and speed limits shall be set and
posted as "20 miles per hour, when children are present," in the following locations:
Note: The required word change required in 10.20.010 appears to be the result of a
scrivener's error.
35 10.28.010 Use prohibited. The use and operation of motorized vehicles on
36 property owned or administered by the Whatcom County park department and set forth
37 as follows is prohibited:
38 A. Pine and Cedar Lakes Trail. The trail, trail head and adjacent properties
39 known as the Pine and Cedar Lakes Trail, described as follows: Trail starts
40 approximately two and one -half miles est of the North Samish from I -5 on North Samish
41 Road. The property in question more exactly being within the following sections of
42 Township 37 North, Range 3 East, W.M.:
43 1. Section 17: The SE 1/2, SE 1%4, SW 1/4; and the SW 1/2, SW 1/4, SW 1/4;

TITLE 15 - BUILDING AND CONSTRUCTION
Note: It appears that Ordinance 92 -57 contained a scrivener's error which resulted in the
need for this change to Section 15.04.160.
15.04.160 Subsection 3207 (e) amended -- Drainage. Subsection 3207(e) of the
Uniform Building Code, 1991 Edition, is hereby * amended to read as follows:
(e) Drainage Prohibited Over Public or Private Property. Roof and
surface drainage water from a building or structure shall not be permitted
to flow over public property nor shall roof drainage be permitted to flood
over adjoining property without the consent of the adjoining property
owner. All drainage shall be disposed of in a manner consistent with
County regulations.
Note: The change to 15.08.090 is recommended due to an apparent scrivener's error.
15.08.090 Section 204 amended -- Violations and penalties. Section 204 of the
Uniform Mechanical Code, 1991 Edition, is hereby amended to read as follows:
Any person, firm or corporation violating any provision of this Chapter or of the
Codes adopted by reference by this Chapter, shall be deemed guilty of a civil defeose
:€ and each day during which such violation is continued or committed shall
constitute a separate off-ease €, and shall be fined not more than one thousand
dollars ($1,000.00) for each offense.
