Randall, property owner in the Lake Management District No. 1, applied for a water permit quantity reduction with the Department of Ecology according to the policy outlined in the March 1, 1993 letter from the Whatcom County Health Department (see Exhibit 2). The Department of Ecology subsequently granted a superseding water permit for Mr. Randall, reducing public waters to be appropriated from .02 cubic feet per second (cfs) to .01 cfs on his permit ( #24667). Since rates and charges for Lake Management District No.1 were partially based on water quantity appropriated, Mr. Randall is entitled to a reduction in his LMD charge. This ordinance reduces the water permit charge on parcel #370335 - 555324 owned by Charles R. Randall. A reduction of this amount will not jeopardize the 21 projects as budgeted. 22 23 NOW, THEREFORE, BE IT ORDAINED that Ordinance 92 -040 be amended as 24 follows: 25 SECTION 1. Confirmation. The Whatcom County Council hereby accepts the 26 Whatcom County Hearing Examiner's recommendation and finds and determines that the 27 final rates and charges roll for Lake Management District No. 1 is just and equitable. 28 Accordingly, the final rates and charges roll (Exhibit A), in the total amount of $7x:05 29 $71,139.16 (Q4268 $42,261.79 Retention Dam Project and $28,877.37 Stream Channel 30 Clearance Project) is hereby approved and confirmed, and the rates and charges set forth 31 therein are hereby levied against each lot, tract and parcel of property described in the roll. 32 33 SECTION 2. Collection. The Clerk of the Council is hereby directed to place 34 the Lake Management District No. 1 rates and charges roll. in the hands of the County 35 Treasurer for collection. Upon delivery of such roll, the amount of each rate and charge 36 set forth in the roll, together with any interest or penalty imposed from time to time, shall 37 become a lien against the property so charged. The lien shall be paramount and superior 38 to any other lien or encumbrance whatsoever, theretofore or thereafter created, except a 39 lien for general taxes and local and special assessments of the county (RCW 36.94.150). The amount of any charge, or any portion thereof, against property in Lake Management District No. 1 not paid within the 30 -day period from the date of the Treasurer's notice shall be payable with interest on the principal balance at a rate of 8% per annum. Interest shall commence on the 30th day following such notice. SECTION 4. Penal . Any charges not paid when due shall thereupon become delinquent. All delinquent charges shall be subject to a penalty equal to 10010 of the amount due, including interest, from the date of delinquency until paid. BE IT FURTHER ORDAINED,. that Exhibit A which was attached to Ordinance 92 -040 as passed and adopted on July 7, 1992 is hereby amended as shown in Exhibit 1 attached. BE IT FURTHER ORDAINED, that all other terms and conditions of Ordinance 92 -040 and Exhibit A will remain in full force and effect.
