The ordinance will appropriate $1,600 from the Paths & Trails fund balance to an appropriate professional
ices account (to be determined). This ordinance is pursuant to a motion passed by the Council at it's meeting
ol: December 17, 1993 whereby the Council waived the request for proposals process and indicated a desire to
see that necessary paperwork was to be prepared prior to the end of 1992 to secure funding from the Non -
Motorized Transportation Improvement Program /D.O.T. Enhancement Grant Awards that would otherwise
expire. Because the Administration indicated that staff was unable to prepare the necessary documentation, the
Council motion recognized that Ken Wilcox was prepared to perform the work on behalf of the County. For that
work, the Council motion stated an intention to appropriate funds as a professional contract expense.

3 AMENDING THE 1993 PATHS AND TRAILS FUND BUDGET
4 TO APPROPRIATE MONEY FOR PROFESSIONAL SERVICES

7 WHEREAS, the Council has been made aware that it was necessary to complete
8 paperwork to secure grant funding from the Non - Motorized Transportation Improvement
9 Program /D.O.T. Enhancement Grant Awards prior to the end of 1992; and

11 WHEREAS, the Council finds that securing the grant funds will be of benefit to
12 the citizens of Whatcom County by augmenting County efforts to increase non - motorized
13 transportation options, including paths and trails; and
14
15 WHEREAS, the Council was informed that County staff would not be able to
16 complete the required paperwork within the time period allowed; and
17
_8 WHEREAS, the Council found that it was necessary to take immediate action to
19 secure the benefits of the grant funding for the citizens of Whatcom County and further
20 found that the necessary services could be performed by a private contractor at a cost
21 under the threshold necessary for competitive bidding for professional services; and
22
23 WHEREAS, the Council at its meeting of December 17, 1992 passed a motion
24 waiving any requirements for issuing a request for proposals, and also indicating that it
25 was their intent to amend the 1993 Paths and Trails Fund budget to provide up to $1,600
26 in professional services funding so that Ken Wilcox, an independent contractor, could
27 complete the necessary paperwork prior to the end of 1992 in anticipation that
28 compensation would be available in the future to compensate him for his efforts;

30 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
31 the sum of one thousand six hundred dollars ($1,600) is hereby appropriated in the Paths
32 and Trails Fund for professional services related to previously completed paperwork
33 required for the Non - Motorized Transportation Improvement Program /D.O.T.
34 Enhancement Grant Awards; and the Paths and Trails Fund balance is decreased by an
35 equivalent amount.

37 BE IT FURTHER ORDAINED that the Administration is directed to prepare
38 and process a purchase order, contract or other such paperwork as may be necessary, to

provide appropriate payment to Ken Wilcox for work performed on behalf of the County
in securing these grants.

' CLEWS NOTE. This ordinance has not been signed by the County Executive. This ordinance was passed
unanimously January 26, 1993. The Executive indicated by memo (on file) that she would not sign the ordinance
and stated some specific objections she had. The Council was advised by legal counsel that there were some
procedural difficulties with the ordinance so it is being repealed on AB93 -OOIA which will be introduced on the
March 23 agenda. The money to pay Mr. Ken wilcox is being appropriated through other channels.
