5 ORDINANCE AMENDING ORDINANCE NO. 89 -56
ASSIGNING THE NON- EXCLUSIVE FRANCHISE FROM
6 GLACIER CABLE PARTNERS LIMITED TO
TCI CABLEVISION OF WASHINGTON, INC.
WHEREAS, on July 6, 1989, Whatcom County Council approved and granted a
8 franchise to Glacier Cable Partners Limited for a period of twenty -five (25)
years; and
9 WHEREAS, Phoenix Glacier Cable Joint Venture currently owns and operates
10 the cable television system under the franchise as a result of the insolvency of
Glacier Cable Partners Limited; and
11 WHEREAS, Phoenix Glacier Cable Joint Venture desires to assign the
12 franchise to TCI Cablevision of Washington, Inc. upon consummation of the sale
of the system; and
13. WHEREAS, Phoenix Glacier Cable Joint Venture will transfer all rights,
14 obligations, title, and interest over to TCI Cablevision of Washington, Inc.;
15 NOW, THEREFORE, BE IT ORDAINED that, pursuant to Section 17 of Ordinance
No. 89 -56, the Whatcom County Council hereby consents to the transfer and assign -
16 ment of the franchise to TCI Cablevision of Washington, Inc., which shall receive
all benefits and be held to all of the responsibilities of the franchise arising
17 after consummation of the sale described above.
18 BE IT FURTHER ORDAINED that this consent shall be considered effective
as of the date of consummation of the sale to TCI Cablevision of Washington,
19 Inc. as described above.
