The Council was petitioned by 184 residents (mostly residents of Birch _Bay Drive) to establish the weight limit
on Birch Bay Drive. The ordinance was requested due to substandard lane width, large volumes of pedestrian
1 bicycle traffic, an historical record of excessive speeding, lack of sufficient traffic enforcement, the residential
and resort nature of this community and the desire for a measure of safety and quiet.
The request is for a five -ton Gross Vehicle Weight (GVW) but the County Engineer has recommended a 15 -ton
limit to allow school buses and service vehicles to utilize the roadway (with emergency vehicles being exempt).

1 ORDINANCE NO. 94 -030
2 ESTABLISHING A WEIGHT RESTRICTION
3 ON A PORTION OF BIRCH BAY DRIVE
4 WHEREAS, the Whatcom County Council is authorized under RCW 46.44.080 to
5 impose weight restrictions on certain County Roads; and
6 WHEREAS, the residents living along Birch Bay Drive between Harborview
7 Road and Shintaffer Road have requested that the County place a five -ton weight
8 restrictions to limit through truck usage on this portion of Birch Bay Drive; and
9 WHEREAS, the Engineering Department recognizes that alternate through truck
10 routes are available and concurs that a weight restriction would be advisable but that
11 certain exemptions are required to adequately serve the public.
12 NOW, THEREFORE, BE IT ORDAINED by the Whatcom County Council that
13 weight restrictions be set at a maximum five -ton gross vehicle weight for through traffic
14 on Birch Bay Drive from Harborview Road to Shintaffer Road, located in Sections 24
15 and 25, Township 40 North, Range 1 West, W.M., although school buses, local service
16 and delivery vehicles, and emergency vehicles shall be exempt.
17 BE IT FURTHER ORDAINED that the County Engineer is hereby directed to
18 post the appropriate signs and that the Whatcom County Sheriff and the Washington
19 State Patrol be notified by a copy of this ordinance.
20 Provisions of this ordinance are hereby added to Whatcom county Code Section
21 10.30.
