A RESOLUTION IN THE MATTER OF CONFIRMING
THE F'INA'L ASSESSMENT ROLL .IN ROAD IMPROVE -
7 MENT DISTRICT NO. 4 AND CERTIFYING SAME
TO WTIATCOM COUNTY TREASURER FOR COLLECTION.
9 WHEREAS, a hearing on the final assessment roll of
10 .Whatcom County Road Improvement District No. 4 was held on
11 December 6, 1979 in accordance with Resolution No. 79 -31 after
12 notice given in accordance with law; and
13
14 WHEREAS, due consideration has been given to all
15 objections received and all matters introduced at the hearing;
16
17 NOW, THEREFORE, BE IT RESOLVED, by the County Council
18 of Whatcom County, Washington, as follows:

20 Section 1: The final assessment roll of Whatcom
21 County Road Improvement District No. 4 as prepared by the Whatcom
22 County Engineer, and now on file with the Whatcom. County
23 Council. in the total amount of $
24
25 Section 2: Each of the lots, tracts and parcels
26 of land appearing on the assessment roll is hereby declared to be
27 specially benefited by'-the improvements constructed in Road Improve
28 ment District No. 4 in at least the amount charged against such
29 property, and the assessment: appearing against each are in pro -
30 portion to the total assessments appearing upon the assessment roll.
31 There is hereby levied and assessed against each such lot, tract
32 and parcel of land the amount appearing on the assessment roll.

Section 3: Said assessment roll shall be filed with
the Treasurer of Whatcom County, Washington for collection and
the Treasurer shall publish. notice thereof as required by law
that, said roll is in his hands for collection and assessments or
any portion thereof may be paid at any time within thirty (30)
days from the date of the first publication of said notice without
penalty, interest or oast. The notice of assessment shall be in
substantially the following form:

the improvement of property located. within Road Improvement
District No. 4, Whatcom. County, Washington, for the construction
and installation of .improvements to the roads within the District
is in my hands for collection. All or any portion of any

Section 4: The assessments against the property in
;+Ihaa*com. County Road Improvement District No. 4 not paid within the
30 clay peri.o:.. from the date of the first publication of such
notice shall he payable in ten (10) equal annual installments;
said assessments and unpaid installments thereof shall bear
interest at the rate of 8% per annum, payable annually as set
forth below.
Section 5: Such assessments and installments
thereof shall be payable in the following manner:
1. Assessments or any portion thereof may be paid
without interest or penalty within thirty days of the first pub -
;licat:ion of the notice published by the County Treasurer as
aforesaid.
2. The amount of any assessment not paid within
thirty days o.i` the first publication of the notice published by
the County Treasurer shall be payable in ten (10) equal annual
installments with interest thereon at the rate of 8% per annum.
The first installment of the assessment shall become due and pay-
able during the thirty (30) day period succeeding the date one
year after the date of the first publication of such notice and
annually thereafter each succeeding installment shall become due
and payable in a like manner. Any payment of annual installment
or installments, interest and penalty, if any, shall be in the
exact amount of such installment or installments, interest and
penalty and no partial payment shall be accepted by the Treasurer.
3. Any installment not paid prior to the expiration
of the thirty (30) Clay period, during which such installment is
due and payable, shall thereupon become delinquent. All delin-

k . uent installments shall, until paid, be subject to the charge for
interest a4: the rate of eight percent per annum and to an add-
itional charge of ten percent penalty levied upon both principal
and interest due upon such installment or installments from the
date of delinquency. Collection of such delinquent installments
shall be enforced in the manner provided by law and any unpaid
balance plus interest and penalty may be paid in full at any time.
4. The owners of any lot, tract or parcel of land
may save the same from all liability for the unpaid amount of the
jassessment a any time after the thirty day period herein provided
for their payment without interest, by paying the entire amount of
a:ll installments on said assessment together with all interest due
