5 ?'•ESOLUTION APPROVING PETITION AND AGREEMENT
FOR INSTALLATION OF AUTOMATIC FLASHING LIGHT
6 AT GRANDVIEW ROAD - BURLINGTON NORTHERN, INC.
GRADE CROSSING.

8 WHEREAS, Whatcom County is the Petitioner before
the Washington State Utilities and Transportation
9 Commission, Project No. `.F'.P -K370 (1) , to require
respondent, Burlington Northern, Inc. to change
10 the existing cross -buck sign at the intersection
of Grandview Road and the Intalco spur railroad
11 line to Cherry Point by replacing the cross -bucks
with automatic flashing light traffic control
12 devices, cantilever type, with gates and motion
sensing devices;

AND WHEREAS, Burlington Northern, Inc. has proposed
14 an agreement whereby it will undertake such change
and install the automatic flashing traffic control
15 device at said crossing, with the Federal Highway
Administration paying ninety percent (90 %) of the cost
16 and the county paying ten percent (10 %) of the cost,
as per Item II, City- County Railway Agreement for
17 Federal Aid Safety Projects and per WSDOT City /County
Agreement #GC5517, subject to approval of the
18 Washington State Utilities and Transportation
Commission;

AND WHEREAS, the project hearing can be waived and
20 order can be entered without further hearing by
mutual consent of both the County and Burlington
21 Northern, Inc., and the work thus expedited;
22 AND WHEREAS, the prompt installation of the automatic
flashing control device at this location will
23 promote the . safety and welfare of the people of
Whatcom County;

25 NOW, THEREFORE, BE IT RESOLVED BY THE WHATCOM COUNTY
26 COUNCIL:
27 That the County Executive is hereby authorized to sign
28 and execute the petition and the proposed agreement for project
29 No. RRP- K370(1), to pay ten percent (10 %) of the cost to change
30 the cross -buck sign to automatic flashing control device at the
31 Intalco spur railroad crossing at Grandview Road in behalf of
32 Whatcom County and process same before the Washington State
Resolution -l.
