IN ACCORDANCE with the provisions of R.C.W. 36.22.100 relating to the
cancellation of warrants.
WHEREAS, Revised Code of Washington 36.22.100 provides that cancellations of
warrants leaves the funds as if such warrants had never been drawn;
IT IS HEREBY ORDERED that the County Auditor and County Treasurer be, and
they are hereby, directed to cancel and strike from the records of Whatcom County
certain warrants which, though called by the County Treasurer for payment, have
not been presented within a period of one year from the date of their issuance.

INTERLOCAL OOOPERATION AGREEMENT
FOR KUrUAL AID
THIS AGREEMENT is entered into under the Interlocal
Cooperation Act (Chapter 39.36 R.C.W.) between the City of Ferndale
hereinafter called "City ", and Whatcom County, hereinafter called
"County" by which the respective jurisdictions agree to provide
mutual aid assistaoca.,gs_ provided herein, and to provide for the
subsequent incorporation of other public entities into such mutual
aid program.
WHEREAS, effective control during a major disorder or
lay enforcement operation depends tpon immediate activation of all
possible menpower resources. and bringing this force to bear to pre-
serve life and property at the location of the incident; and
WHEREAS, in the Vhatcom County area, a major disorder or
law enforcement operation may affect more than one jurisdictional
area, thus necessitating such cooperation so that all persons and
property may be protected; and
WHEREAS, it is believed that the sooner a major disorder
or law enforcement problem can be dealt with effectively, the more
protection will be accorded to all citizens; and
WHEREAS, it is necessary and desirable that a cooperative
agreement be executed for the interchange of such mutual aid on a
countywide basis;
NOW, THEREPOR99 the parties hereto agree as follows:
• 1. In the event of major disorder or other law enforce-
ment problems the first ler onforeemeet resource, to be utilized shall

such resources on Ise6quats to ofttrol the situation, a request for
aid under We plan will be leads directly to the assisting agency.
Such requests for assistance shall be, whenever possible, specific

as to the number of officer personnel and types of quipment required,
and shall specify where and to whom such officer are to report and
the equipment to be delivered.
2. Subsequent to the execution of this Agreement, the
parties hereto anticipate that the Lw ems • ap=zie& r- rte-

to this agreement. In such event the agreement shall be so modified
so as to provide for such membership. At the time additional juris-
dictions become participants, the Whatcom County Sheriff shall there-
after be designated as the law enforcement mutual aid coordinator for
assistance, irrespective of which jurisdiction the incident precipi-
tating the request comes from.
3. It is agreed that in the event of mobilization under
this agreement, the City shall take charge of the operation, unless
the City specifically requests that Whatcom County fulfill this par-
ticular role. Such shall include directing the assignment of all
personnel and equipment provided through the execution of the mutual
aid plan. The assignment of aissions to officers of assisting agen-
cies shall be made by the responsible officer of the mutual aid
coordinator at the scene. Provided, however, that notwithstanding
the above, all First Class Cities shall remain in charge of any
incident occurring within their corporate boundaries and the police
chief thereof or his designate shall perform all the coordination
and assignment functions otherwise assigned to the responsible
officer of the mutual aid coordinator.
4. The City agrees to provide the Whatcom County Sheriff
with the names, addresses, and phone numbers of its staff who have
the authority to commit manpower or equipment to any mobilization
effort. All other jurisdictions subsequently becoming parties to
this agreement shall also provide such information.
5. It is mutually agreed that all agencies participating
in this mutual aid.agreemeot will anke all press releases through
the agency or authority having primary jurisdiction, or jointly by
agencies having concurrent jurisdiction.

6. Any agency requesting mutual aid will have the
responsibility of establishing a command post at some predesignated
location. The requesting agency shall establish a command post in
such a manner as to provide an area suitable for the staging and
directing of resources, and shall inform the Whatcom County She riff
as well as the Duty Officer of other responding agencies of the
location of the copmaQ post and staging area at the time the request
for mutual aid is made, or as soon thereafter as is practicable.
7. Arrest policies will be determined by mutual agree-
ment of the involved agencies.
8. Transportation of prisoners to the City of Bellingham
or Whatcom County Jails vill be coordinated the the official in charge
of the incident, provided such transportation is needed.
9. The City and Whatcoe County agree that their respec-
tive jails shall be wood to receive prisioners resulting from any mass
arrest when the authority Saving jurisdiction is unable to handle them
due to their large number or because of other reasons. All prisoners,
once delivered into the custody of a jail, will be handled by normal
policy and procedures of that jail. Every effort, consistent with the
circumstances, will be made to protect the rights of each prisoner.
10. The law enforcement agency requesting mutual aid will
be responsible for supplying and /or replacing supplies needed and /or
used by officers from outside jurisdictions. These supplies include
food, gas for police vehicles. tear or CS gas, or any other supplies
that are reasonably needed to sustain the officers inenforcing the
law, maintaining order, or aiding in restoring the situation to nor-
mal condition.
11. The law enforcement agency requesting mutual aid will
not be responsible for salaries or overtime pay for officers assist-
ing from other jurisdictions. The requesting agency will be respon-
sible for any and all liabilities to third parties exclusive of the
officer themselves, except false arrest, arising out of incidents
where assisting officers are acting as agents for that agency. It

is agreed that all agencies will insure their own officers for false
arrest, whether working within or outside their normal jurisdictions.
12. Whenever any commissioned officer of a city or the
County, acting pursuant to this agreesaat, is disabled or is other -
wise injured from performing his duties by reason of engaging is the
apprehension or atte*ted4ipprehension of law violators or suspected
law violators, or protection of preservation of life or property, or
the preservation of the peace anywhere in the county, including the
local jurisdiction in which he is employed, but is not at the time
acting under the immediate direction of his employer, he or his de-
pendents, as the case may be, shall be accorded by his employer the
same benefits which he or they would have received had that officer
been acting under the immediate direction of his employer in his own
jurisdiction. It is further agreed that assisting agencies will ap-
pear, defend, indemnify and hold harmless the requesting agency from
any claim filed for false arrest as a result of actions by the assist-
ing officer.
13. Full time, paid, x e '"coned personnel from one a-
gency who are responding to nay call from another agency for mutual
aid shall be automatically eoasissi«ed by virtue of this agree-
went, through the commissioning authority of the signato6 request-
ing agency and, therefore, shall be empowered to exercise the same
police authority during the time of the mutual aid as though he were
a full time commissioned officer of the requesting spacq. This
provision shall apply whether the mutual aid request is pis (1) a
formal nature between depastesnt heads; of (2) a less formal nature
through agreement of the Watch Commanders of Shift Supervisors; or
(3) when the personnel of one jurisdiction cross juriadfctional
boundaries to aid or assist the personnel of another jurisdiction
signatory to this pact, when such assistance is requested by the per- •
sonnel of the second jurisdiction.
14. In the event signatory agencies have reseive per-
sonnel, or part itme officers, in addition to full time, paid,
commissioned personnel, such persons shall normally be extpt for

the automatic commissioning as outlined above in paragraph 13.
Reserve or part time officers may be extended automatic commis-
sioning at the direction of the department head who request mutual
aid, PROVIDED HOWEVER, that such determination should be worked
out in advance with the heads of any signatory agency whose response
might include reserve or part time officers at the time the request
for mutual aid is instituted.
15. Each signatory agency shall develop and maintain
a current plan or precedure providing;, for the effective mobilization
of its meapawer and other resources, in a configuration appropriate
for the provision of mutual aid to the other signatory agencies, and
shall be filed with the Sheriff of the County and reviewed by
him as befits his role as law enforcement mutual aid coordinator and
chief law enforcement officer of the county. These plans should be
kept current and reviewed by the individual agencies at least once
annually.
16. Any signatory agency any withdraw from this agreement
after a period of twenty (20) days has elapsed from notification
made by registered letter to the other signatory agencies' normal
business address. Withdrawal of any one party under this section
shall not affect the continued authority of the agreement if any
two (2) or more signatory agencies wish to continue the agreement.
17. Venues This igreement has been and shall be construed
as having been made and delivered in the State of Washington, and
it is mutually understood and agreed by each party hereto that
this agreement shall be governed by the laws of the State of Washing-
ton, both as to interpretation and performance.
Any action in law, suti in equity, or judicial proceedings
for the enforcement of this agreement or any provisions thereof,
shall be instituted and malaUlned only in the course of competent
jurisdiction in Whatcom County, Bellingham, Washington.
18. Modifications No changes or modivications of this
agreement shall be valid or binding upon either party to this agreement

both parties.
19. Non - Discrimination: The CITY shall not discriminate
against any employee or applicant for employment because of race,
color, religion, sex, or national origin. They shall take affirma-
tive action to i,ttauq that applicants are employed and that employees
are treated during employment, without regard to their race, color,
religion, sex or national origin. Such action shall include, but
not limited to the following: employment, upgrading, denlntions, or
transfers, recruitment or recruitment advertising; layoffs or tens
inations; rates of pay or other forms of compensation; selection for
training including apprenticeship; and participation in recreational
and education activities. They agree to post, in conspicuous places
available to employees and applicants for employment, notices inden-
tical to those used setting forth the provisions of thins non-
discrimination clause. In all solicitations or advertisements for
employees placed by them or on their behalf, the CITY shall state
that all qualified applicants will receive consideration for eq)lov-
mrnt without regard to race, color, religion, sex or national on (-.in.
They shall cause the foregoing provisions to be inserted in all sub-
contracts for any work covered by this agreement so that such pro -
visions will be binding upon each subcontractor; PROVIDED that the
foregoing provisions shall not apply to contract or subcontracts for
standard cowAarcial supplies or raw materials.
20. Notices: Any notice required or permitted to be
Ei:•en under this agreement shall be deemed sufficient if given
in writing and sent by registered or certified mail. In the cabe

In the case of the City the address shall be: Mayor of Blaine
Blaine City Hall, Blaine, Washington.
