HomeMy WebLinkAboutres1979-010;s Date June 21, 1979 Introduced by: Hansey Proposed No. Water Dist. #16 RESOLUTION NO. 79/10 A RESOLUTION CLARIFYING WHATCOM COUNTY COMPREHENSIVE PLAN AS IT APPLIES TO WHATCOM COUNTY WATER DISTRICT NO. 16'5 PROPOSED WATER SUPPLY SOURCE WHEREAS, the Whatcom County Commissioners prior to May 1, 1979 ( April of 1979) approved the formation and boundaries of Whatcom County Water District No. 16, said District having been formed and passed on by the Boundary Review Board; and WHEREAS, said Water District has after formation obtained a loan for $240,000.00 from the State of Washington, Eco- nomic Assistance Authority, for aid in financing the cost of a water supply and distribution system for-the district, which loan approval is contingent upon a favorable response from the A -95 review by the Whatcom County Council of Governments; and Executive Committee of the WHEREAS, the /Council of Governments of Whatcom County the A -95 review hearing held on June 7, 1979, approved the Water District's A -95 application "contingent upon the Whatcom County Council passing a resolution to the at unaniinous l� effect that the 1969 comprehensive plan for water service in Whatcom County naming Lake Whatcom and the City of Bellingham filtration plant as the source of the water north to the Smith Road, shall not apply in the instance of Water District 16's proposed water source within its district "; and . WHEREAS, the 1969 comprehensive plan for Whatcom County in relation to the water source for Water District 16 is on the one hand not technically consistent with the Water District's proposed well source for water from within the District's bAndaries, while on the other hand said 1969 comprehensive-la-14n can be interpreted as con- sistent with the said well site water source; and WHEREAS, it is considered that the technical inconsistencies of the comprehensive plan need to be resolved as expeditiously as possible to enable the Water District to proceed with their plans and the obtaining of the state loan; and WHEREAS, the Whatcom County. Council is on record as deeming the planning regard'o'�ater needs in Whatcom County as a high priority; and WHEREAS, the property owners within the Water District have previously requested that the City of Bellingham provide them with water which requests were turned down; and WHEREAS, there is now no guarantee that the City would or could supply the Water District with its current and reasonably future expected water needs; and WHEREAS, the Water District needs an adequate water source and has such an adequate water source within its own boundaries which its water plan intends to utilize; NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: SECTION 1. The Whatcom County Council goes on record as reaffirming the Whatcom County Commissioners previous approval of Whatcom County Water District 16 together with said Water District's proposed plan for obtaining water from a well within the District's boundaries. SECTION 2. The 1969 comprehensive plan naming Lake Whatcom in conjunction with the City of Bellingham's filtration plant as a source of water for land areas from Bellingham north to the Smith Road is waived by the Whatcom County Council in this particular instance only for Water District 16's proposed water source from a well or wells within the District's boundaries. SECTION 3. This Resolution is made with the intent of providing the requisite Resolution as requested by the Whatcom County Council of Governments at their A -95 hearing held on June 7, 1979, conditioning their granting approval to the Water District's requested loan application with the Washington State Economic Assistance Authority.
