RESOLUTION NO. 80 -75
A '_ IESOLUTION DECLARING THE FORMATION OF
WHATC0'1 COUNTY WATER DISTRICT #17
WHEREAS, the returns of the election for the formation of a
water district in portions of Townships 4 - -0 aid4l North, Range
3 East and Town�hi.ps40 and 41 North, Ranee 4 East have been
duly canvassed, and
WHEREAS, of the votes cast on the proposition for the formatio
of the water district, 110 votes were cast in favor of the
organization of said district and 48 votes were cast against
the same; that of the votes cast on the proposition authorizin
the water district to levy a general tax of $1.25 per thousand
dollars of assessed value for general preliminary expenses of
the district, 88 votes were cast'in savor of the levy and 55
votes were cast against the levy, said vote being a majority
of three- fifths of the electors thereof voting on the j -)ropo-
sition and being not less than forty percent of the total
number of votes cast in the district at the last preceding
general State election held therein, as provided in '?.C.T'l.
57.04.050.
NOW, THEREFORE, BE IT RESOLVED that Whatcom County Water
(District No. 17, is now a duly organized ;Pater District under the
Maws of the State of Washington, with boundaries established and
Idefined as follows:
A portion of Townships 40 and 41 North, Range 3 East off .'_'.2.,
and a portion of Townships 40 and 41 North, Range 4 East of
W.14., Whatcom County, Washington, bounded and described as
follows:
Commencing at the common corner of Townships 40 and 41 North,
Range 3 East of ,9.M. , and Townshil,')s 40 and 41 North, Range 4
East of Thence North along; the East line of Township
41 North, Range 3 East of W.M. to the international boundary
of the United States of America and the Dominion of Canada
and the true point of beginning-; Thence ?Nest along said
international boundary to the West line of the East half of
the West half of Section 34, Township 41 North, gunge 3 East
of W.111.; Thence South along the West line of said half half'
section, along the 'Vest line of the East half of. the West
half of Section 3, Township 40 North, Range 3 East of IV . i?
and alone; the West line of the Northeast quarter of the North -

tion 1, Section 2, the East half and the East half of the
West half of Section 3, the Northeast quarter of the Northwest
quarter and the North Half of the Northeast quarter of Section
10, the North half of the North half of Section 11, and the
North half of the North half of Section 12, Township 40 North,
Range 3 East of W.M.; ALSO the West half of the West half of
Section 4, Section 5, Section E, the North half of the North
half of Section 7, the North half of the North half of Secti.
8, and the Northwest quarter of the Northwest quarter of
Section 9, Township 40 North, Range 4 East of W.M.; and ALSO
that portion of Section 31, Section 32, and the West half of
the West half of Section 33, Township 41 North, Range 4 East
of W.M., lying southerly of the Unites States of America -
Dominion of Canada International Boundary.
EXCEPT the following described property:
The Northeast quarter of the Southeast quarter, and the South
half of the Northwest quarter of the Southeast quarter, and
the Southwest quarter of the Southeast quarter, all located
in Section 34, Township 41 North, Range 3 East of W.M.,
ALSO EXCEPT the Northeast quarter of the Northwest and East
one -half of Government Lot 1 and North 220 feet of the West
one -half of Government Lot 1, Section 7, Township 40 North,
Range 3 East of W.M.
BE IT FURTHER RESOLVED that the following are the duly elected
Commissioners of Whatcom County.Water District No. 17:
Curt Lenssen (six year term) District No. 1
Cap Galloway (four year term) District No. 2
Frank Steiner (two year term) District No. 3
APPROVED by the Whatcom County Council this 18th day of
December, 1980.

SUBJECT: Clerical error on Resolution no. 80 -75
It has been brought to my attention that there was a dis-
crepancy between the legal description of Water District
17 as approved by the Boundary Review Board on September
4, .1980, and that of the County Council Resolution no.
80 -75 passed by the Council on December 18, 1980.
The error was on the Council resolution, and involved the
omission of language two paragraphs at the end of the le-
gal description when the resolution was typed. As it is
clearly a clerical error, no amending resolution is nec-
essary. Please substitute the attached resolution for that
that you have already placed on file.
