RESOLUTION NO. 80 -26 A RESOLUTION APPROVING WATER DISTRICT NO. 10's RESOLUTION NO. 276, DATED MARCH 19, 1980, AMENDMENT TO THE COMPREHENSIVE PLAN OF WATER DISTRICT NO. 10 IT IS HEREBY RESOLVED that the Whatcom County Council does approve the amendment to the Comprehensive Plan of Water District No. 10 as it applies to Whatcom County, in Resolution No. 276, dated march 19, 1980. Sorka Civil Deputy Prosecuting Attorney RESOLUTION NO. 276 A RESOLUTION of the Board of Commissioners of Water District No. 10, Whatcom County, Washington, adopting an amendment to the comprehensive plan for a system of water supply of the District as previously adopted; declaring the estimated cost of the improvements included in such amendment; and providing the method of distributing such cost and expense. WHEREAS, on January 19, 1978, the Board of Commissioners (_hereinafter called the "Board ") of Whatcom County Water District No. 10, Whatcom County, Washington (hereinafter called the "Dis- trict"), adopted its Resolution No. 221, providing a cortiprehen- sive plan for a system of water supply for the District; and WHEREAS, the Board has recently again investigated all portions and sections of the District for the purpose of de- termining the present and future needs of the District in regard to water supplies, and has found and determined that the demand for water within the area served by the District requires an amendment to the existing comprehensive plan for a water system for the District; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Water District No. 10, Whatcom County, Washington, as follows: Section 1. The comprehensive plan for a system of water for the District shall be amended to provide that the District shall acquire, construct and install the water facilities described in Exhibit A attached hereto and made a part hereof (hereinafter "amendment to the plan "). It is hereby provided that the amendment to the plan shall be subject to such changes as to details of aqueduct or pipe size or location or any other details of said plan as may be author- ized by the Board either prior to or during the actual course of construction. The District may proceed with the construction and installa- tion of the improvements included in amendment to the plan as herein authorized, either alone or in conjunction with the constructi. of other facilities of the District, and in. whole, or in successive parts or units from time to time as may be found advisable. Section 2., The estimated cost of the acquisition, construc- tion and installation of the improvements included in such amendment to the plan is hereby declared to be, as near as may be, the sum of $ which shall be provided for out of moneys accumulated in the maintenance fund in excess of the requirements of such fund for payment of operating and maintenance expenses and redemption or sezvicing of outstanding obligations of the District. Secti :on 3. This amendment to the plan shall be submitted for approval to an engineer designated by the Whatcom County Council,, to the Whatcom County Director of Health, to the Whatcom County Council, and to the legislative authority of any affected city or town; and shall become effective on the date of approval as provided by law. -2-
