RESOLUTION NO. 80 -25 A RESOLUTION APPROVING AMENDMENT TO WATER DISTRICT NO. 10's COMPREHENSIVE PLAN, RESOLUTION NO. 273 DATED FEBRUARY 27, :1980 IT IS HEREBY RESOLVED that the Whatcom County Council does approve the amendment to the Comprehensive Plan for Water District No. 10, adopted by Water District No. 10, as it applies to Whatcom County, in Resolution No. 273 date::d February 27, 1980. APPROVAL is contingent upon Water District No. 1.0 obtaining necessary approval from the Department of Social and Health Services and the Department of Ecology. Serl4i Civil Deputy Prosecuting Attorney Acting ChairvK.gn i RESOLUTION NO. 273 A RESOLUTION of the Board of Commissioners of Water District No. 10, Whatcom County, Washington, adopting an amendment to the comprehensive plan for a system of sewers of the District as previ- ously adopted; and providing for acquisition of the improvements included in such amendment. WHEREAS, on December 2, 1970, the Board of Commissioners (hereinafter called the "Board ") of Whatcom County Water District No. 10, Whatcom County, Washington (:hereinafter called the "Dis- trict "Z, adopted its Resolution No. 104, providing a comprehen- sive plan fora system of sewers for the District; and WHEREAS, the Board has recently again investigated al.l portions and sections of the District for -the purpose of de- termining the present and future needs of the District in regard to its sanitary sewage collection and disposal system, and has found and determined that the demand for sanitary sewage and disposal service within the area :served by the District requires an amendment to the existing comprehensive plan fora sewer system for the District; NOW, THEREFORE, BE IT RESOLVED by the Board. of Commissioners of Water District No. 10, Whatcom County', Washington, as follows: Section 1. The comprehensive plan for a system of sewers for the District shall be amended to provide that the District shall acquire sewer facilities constructed by the property owner and described in Exhibit A attached hereto and made a part hereof (hereinafter. "amendment to the plan ") . In carrying out such amendment to the plan, the District shall acquire all manholes, lampholes, wyes, valves and other equipment and appurtenances necessary for its proper operation and shall acqui.ze by purchase, lease or condemnation all property, both real and personal. or any interest therein, and all rights- of-way, franchises, and easements necessary to carry out said plan, which is all as more particular ?v set forth in maps and plans prepared or approved by Yoshida Incorporated, consulting engineers of Seattle, Washington. It is hereby provided that said amendment to the plan shall be subject to such changes as to details of pipe size or location or any other details of said plan as may be authorized by the Board either prior to or during the actual. course of construction. Section 2. The acquisition of the improvements included in such amendment to the plan shall be by payment of the sum of s� $ / to and bill of sale from the property owner. Section 3. This amendment to the plan shall be submitted for approval to an engineer designated by the Whatcom County Council, to the Whatcom County Director of Health, to the Whatcom County Council, and to the legislative authority of any affected city or town; and shall become effective on the date of approval as provided by law.
