A RESOLUTION APPROVING WATER DISTRICT NO. .10's
AMEND?MENT TO THE COMPREHENSIVI_�', PLAN OF THE
DISTRICT, RESOLUTION NO. 253 DATED AUGUST 8, 1979.
IT IS HEREBY RESOLVED that the Whatcom County Council
does approve the amendment to Plater Distract No. 10's Comprehensiv
'Plan adopted by the Whatcom County W -,)ter District No. 1 -0 as it
applies to Whatcom County in Resolution No. 253, dated. August 8,
1979, subject to obtaining the requisite a.ppt -oval from the Depart-
ment of Social and Health Services and the Department of Ecology.
IN ADDITION, this approval of the County Council will
be subject to the construction and improvement of roads in the
subject area guaranteed to the satisfaction and approval. of the
Whatcom County Engineer.

A RESOLUTION of the Board o COrrullissioners of
Whatcom County Water District No. 10, Wj- iatcom
County, Waslain.gton, adol_t.>.ng an arnendntient to
the comprehensive plan for a system of sewers
of the District as pr.evious1y adopted and
amended; declaring the esti.ma.ted cost_ thereof;
providing the method of paying the cost and
expense of such amendment; arid providing that
such cost and expense shall be paid from the
proceeds of sale of sewer revenue bonds of the
District payable out of sewer service charges
and assessments.
WHEREAS, on December 2, 1970, the Board of Commis-
sioners (hereinafter called the "Board ") of Whatcom County
Water District No. 10, Whatcom County, Wa'shindton (herein-
after called the "District "), adopted its Resolution No. 104,
providing a comprehensive plan for a system of sewers for the
District and calling a special election on the propo;;.ition
to authorize the issuance of sewer revenue bonds or water ar.d
sewer revenue bonds of the District for the purpose of provid-
ing funds to pay the cost of carrying out said comprehensive
plan; and
WHEREAS, at said special election the qualified
electors of the District authorized the issuance of such sewer
or water and sewer revenue bonds in the manner provided by law;
and
WHEREAS, the Board has recently again investigated
all portions and sections of the District for the purpose of
determining the present and future needs of the District in
regard to its sanitary sewage collection and disposal system,
and has found and determined that the demand fox, sanitary sewagF>
disposal service within the area served by the District requires
an amendment to the existing comprehensive plan for a sewer
system for the District;
NOW, THEREFORE, BE IT RESOLVED by the Board of Corrnmis-
sioners of Whatcom County Water District No. 10, Whatcom
County, Washington, as follows:
Section 1. The comprehensive plan for a systern of
sev-ers for the District shall be amended to provide that the
District shall acquire, construct and install the sewer facil-
ities described in Exhibit A, attached hereto and made a part
hereof (hereinafter "amendment to plan ").
In carrying, out such amendment to plan the District
shall acquire and install all manholes, lampholes, wyes, valves
and other equipment and appurtenances necessary for its proper
operation and shall acquire by purchase, lease or condemnation
all property, both real and personal or any interest therein,
and-all right -of -way, franchises and easements necessary to
carry out said plan, which is all as more particularly set
forth in maps and plans prepared by Yoshida Incorporated,
consulting engineers of Seattle, Washington.
It is hereby provided that said amendment to plan shall
be subject to such changes as to details of pipe size or loca-
tions or any other details of said plan as may be authorized
by the3 oard either prior to or during the actual course of
construction.
The District may proceed with the construction and
installation of the.amendment to plan as herein authorized,
either alone or in conjunction with the construction of other
facilities of the District, and in whole, or "in successive
parts or units from time to time as may be found advisable.
Section 2. The estimated cost of the acquisition,
construction and installation of such amendment to plan is
hereby declared to be, as near as may be, the sum of $138,000.
which shall be provided by the issuance and. sale of sewer

revenue bonds of the District in an amount not to exceed
such principal amount, reduced by any loans or grants secured
by the District.
Said revenue bonds shall bear interest payable semi-
annually and evidenced to maturity by coupons to be attached
thereto bearing an interest rate of not to exceed the maximum
rate permitted at the time said bonds are sold, shall be
issued at such time as may be found necessary, and shall
mature in various amounts and at such times up to a maximum
period of not to exceed thirty years from date of issue as may
be fixed b, the Board. =Both principal of and interest on said
bonds shall be paid from the gross revenue of 'the District and
from assessments, if any, as hereinafter provided. The exact
date, form, terms and maturities of said bonds shall be as
hereafter fixed by resolution of the Board of Commissioners.
Section 3. It is contemplated that all of the land
within the District which will be specially benefited by the
construction and installation of the sewer improvements generally
described in this resolution will be included in one or more
utility local improvement districts, and that assessments be
levied in such district or districts in an amount to be fixed
by the Board of Commissioners for each such district, but not
to exceed the cost of all such improvements and within the
special benefits received. All of the assessments as levied
in such utility l.ocal.improvement district or districts shall
be collected and paid into a revenue bond redemption fund to
be hereafter designated and applied solely in payment of the
principal of and interest on sewer_ revenue bonds of the District.
Section 4. This amendment to plan shall be effective
as of the date on which it has been approved by an engineer
designated by the Board of Commissioners of Whatcom County,

the Board of Commissioners of Whatcom County, and by resolu-
tion of the legislative authority of any affected city or town.
