WHEREAS, 'hearing on the final assessment roll of Johnson Creek Drainage Improvement District No. 31 was held on February 7, 1980, after notice given in accordance with law; and WHEREAS, due consideration has been given to all objections received and all matters introduced at the hearing. NOW, THEREFORE, BE IT RESOLVED by the County Council of Whatcom County, Washington, as follows: Section 1: The final assessment roll of Johnson Creek Drainage Improvement District No. 31, now on file with the County Council:of Whatc,om County be and the same is hereby accepted and confirmed in the total amount of.$18,000.00'' �Secti.on'2: Each of the lots, tracts and parcels of land appearing`on the assessment roll.is hereby declared to be specially benefited,,by the improvments constructed in Johnson Creek Drainage .Improvement District No. 31 in at least the amount charged against such property, and the assessment appearing against each are in proportion to the total assessments appearing upon the assessment roll. There is hereby levied and assessed against each such lot, Resolution. - 1. Section 3: Said assessment roll shall be filed with the Treasurer of Whatcom County, Washington for collection and the Treasurer shall publish notice thereof as required by law that said roll is in his hands for collection and assessments or any.portion thereof may be paid at any time within thirty (30) days from the date of the first publication of said notice with- out penalty, interest or cost. The notice of assessment shall be in substantially the following form: NOTICE OF ASSESSMENT JOHNSON CREEK DRAINAGE IMPROVEMENT DISTRICT NO. 31 WHATCOM COUNTY, 1-17ASHINGTON Notice is hereby given that the assessment roll for the improvement of property located within the Johnson Creek Drainage Improvement District No. 31, Whatcom County, Washington, for the maintenance of the system of improvements for the.District is in my hands for collection. A11. or any portion of any assessment may be paid within 30 days from the date of the first publication of this notice) without penalty, interest or costs and the unpaid balance, if any,:may be paid in two (2)., equal installments, one half payable, on or.before May 30, 1980, and the other half on or before November 30, 1980, with interest thereon at the rate.of eight percent (8 %) per annum, or the lien of any such assessment may be discharged at any time after the rfirst 30 days following the date of the,first publicatio; of this notice by paying the entire amount of the assessment re- maining unpaid with interest thereon to the due date of the installment next falling due. Section 4: The assessments against the property in Whatcom,County Drainage Improvement District No. 31 not paid within the 30 day period from'the date of the first publication of such notice shall be collected in the same manner and shall become delinquent at the same time as general taxes, payable in two (2) equal installments; one half being payable on or before May 30th, 1980, and the other half on or before November 30, 1980; said assessments and unpaid installments thereof shall bear interest at the rate of eight percent (8o) per annum, from said date on.said respective halves of said assessments. Section 5: Such assessments and installments thereof shall be payable in the following manner: 1. Assessments or`,'any portion thereof may be paid without interest. or 'penalty within thirty days of ,"the first pub- lication of the notice published by the County Treasurer as aforesaid,:, _ 2. The amount of any assessment not paid within thirty days (30) of the first publication of the notice published by the County Treasurer shall be payable: in two (2) equal installments with interest thereon at the rate of eight percent (8 %) per annum. The first installment (one half of the assessment) shall become due and payable on or before May 30th, 1980, and the other half on or before Ncv mber 30, 1980.. Collection of such delinquent assessments shall be enforced in the mariner provided by law and any unpaid balance plus interest and penalty may be paid in full at any time. 4. The owners of any lot, tract or parcel of land may serve the same from all liability for the unpaid amount of the assessment at any time after the thirty (30) day period herein provided for their payment without interest, be paying the entire amount on said assessment together with all interest due to the date of maturity of the installment next falling due..
