APPROVAL is contingent upon Whatcom County Water District No. 10 obtaining necessary approval from ;'lashington State Department of Social and Health Services and ;Yashincrton State Department of Ecology. WHEREAS, on December 2, 1970, the Board of Commissioners (hereinafter called the "Board ") of Whatcom County Water District No. 10, Whatcom County, Washington (hereinafter called the "Dis- trict"), adopted its Resolution No. 104, providing a comprehen- sive plan for a system of sewers for the District and calling a special election on the proposition to authorize the issuance of sewer revenue bonds or water and sewer revenue bonds of the District for the purpose of providing funds to pay the cost of carrying out said comprehensive plan; and WHEREAS, at said special election the qualified electors of the District authorized the issuance of such sewer or water and sewer revenue bonds in the manner provided by law; and WHEREAS, the Board has recently again investigated all portions and sections of the District for the purpose of determin- ing the present and future needs of the District in regard to its sanitary sewage collection and disposal system, and has found and determined that the demand for sanitary sewage and disposal service within the area served by the District requires an amend- ment to the existing comprehensive plan for a sewer system for the District; NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of Water District No. 10, Wi�atcom County, Washington, as follows: Section 1. The comprehensive plan for a system of sewers for the District shall be amended to provide that the District shall acquire, construct end install the sewer facilities described in Exhibit A attached hereto and made a part hereof (hereinafter "amendment to the plan "). In carrying out such amendment to the plan the District shall acquire and install all manholes, lampholes, wyes, valves and other equipment and appurtenances necessary for its proper operation and shall acquire by purchase, lease or condemnation all property, both real and personal or any interest therein, and all rights -of -way, franchises, and easements necessary to carry out said plan, which is all as more particularly set forth in maps and plans prepared by Yoshida Incorporated, consulting engineers of Seattle, Washington. It is hereby provided that said amendment to the plan shall be subject to such changes as to details of pipe size or location or any other details of said plan as may be authorized by the Board either prior to or during the actual course of construc- tion. The District may proceed with the construction and installa- tion of the amendment to the plan as herein authorized, either alone or in conjunction with the construction of other facilities of the District, and in whole, or in successive parts or units from time to time as maybe found advisable. Section 2. The estimated cost of the acquisition, construc- tion and installation of such amendment to the plan is hereby de- clared to be, as near as may be, the sum of $40,000 which shall be provided by the issuance and sale of sewer revenue bonds of the District in such principal amount, reduced by any loans or grants secured by the District. As a part of this plan it is contemplated that such costs may be paid out of the proceeds of an inter -fund loan pending the issuance of such revenue bonds. Said revenue bonds shall bear interest payable semiannually to maturity and evidenced by coupons to be attached thereto dM bearing an interest rate of not to exceed the maximum rate permit- ted at the time said bonds are sold, shall be issued at such time as may be found necessary, and shall mature in various amounts and at such times up to a maximum period of not to exceed thirty years from date of issue as may be fixed by the Board. Both principal of and interest on said bonds shall be paid from the gross revenue of the District and from assessments, if any, as hereinafter provided. The exact date, form, terms and maturities of said bonds shall be as hereafter fixed by resolution of the Board of Commissioners. Section 3. It is contemplated that all of the land within the District which will be specially benefited by the construction and installation of the sewer improvements generally described in this resolution will be included in one or more utility local improvement districts, and that assessments be levied in such district or districts in an amount to be fixed by the Board of Commissioners for each district, but not to exceed the cost of all such improvements and within the special benefits received. All of the assessments as levied in such utility local improvement district or districts shall be collected and paid into a revenue bond redemption fund and applied solely in payment of the princi- pal of and interest on sewer revenue bonds or water and sewer revenue bonds of the District. Section 4. This amendment to the plan shall be submitted for approval to an engineer designated by the Whatcom County Council, to the Whatcom County Director of Health, to the Whatcom County Council, and to the legislative authority of any affected city or town; and shall become effective on the date of approval as provided by law. -3- PASSED by the Board of Commissioners of Water District No. 10, Whatcom County, Washington, at its regular meeting on the 1st day of July, 1981.
