A RESOLUTION IN THE.MATTER OF
4 THE MERGER OF THE.WHATCOM COUNTY
AIR .POLLUTION CONTROL AUTHORITY
5 IN ORDER TO FORM A MULTI - COUNTY
AIR POLLUTION CONTROL AUTHORITY

7 WHEREAS, San.Juan County has tendered its withdrawal
8 from the Northwest Air Pollution Authority; and,
9 WHEREAS, the aforesaid withdrawal will necessitate the
10 dissolution of the Northwest Air Pollution Authority (presently
11 composed of Whatcom, San Juan, Skagit and Island Counties), and
12 the formation of a new authority; and,
13 WHEREAS, it is the public policy of Whatcom County to
14 secure and maintain such levels of air quality as will protect
15 human health and safety and, to the greatest degree practicable,
16 Prevent injury to plant and animal life and property, foster the
17 comfort and convenience of its inhabitants, promote the economic
18 and social development of the County and facilitate the enjoyment
19 of the natural attractions thereof; and,
20 WHEREAS, the Legislature of the State of Washington has
21 by Chapter 238, Laws of the State of Washington 1967 (Regular
22 Session), (RCW 70.94) enacted the "Washington Clear Air Act; and,
23 WHEREAS, Section 6 and Section 11 of said Chapter 238,
24 Laws of 1967 (Regular Session), authorizes the legislative authority
25 of two or more contiguous counties, by joint resolution, or the
26 adopting of similar resolutions, to merge to form a multi - county
27 air pollution control authority;
28 NOW, THEREFORE, BE IT RESOLVED, pursuant to Chapter 238,
29 Laws of the State of Washington, 1967 (Regular Session) that the
30 Whatcom County Air Pollution Control Authority shall merge with the
31 contiguous air pollution control authority in Island County and
32 Skagit County to form a multi - county air pollution control authority

to be known as the Northwest Air Pollution Authority, said multi -
county air pollution control authority to be activated, and begin
doing business commencing January 1, 1983, immediately following
dissolution of the former four - -county authority. Said Northwest
Air Pollution Authority shall have its principal place of business
as the Board of Directors of said authority shall designate, and
shall exercise all the powers, rights and duties pursuant to
Chapter 238, Laws of the State.of Washington, 1967 (Regular Session)
BE.IT FURTHER.RESOLVED. that the effective date of this
Resolution shall be January 1, 1983, immediately following the
effective date of the dissolution of the four county Northwest Air
Pollution Authority.
BE IT.FURTHER RESOLVED that any surplus funds owed to
Whatcom County as a result of the dissolution of the Northwest Air
Pollution Authority as..a four - county authority shall remain with
the merged three - county Northwest Air Pollution Authority.to be
disbursed by.the.Board of Directors of said authority pursuant to
the budget requirements.set. forth in RCW 70.94.092.
