HomeMy WebLinkAboutres1982-0521 2 3 4 5 6 7 8I9 10 11 12 13 14 15. 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31. . 32 DATE: October 7, 1982 PROPOSED BY: County Executive INTRODUCED BY: Johnson RESOLUTION NO.82 -52 A RESOLUTION IN THE MATTER OF THE DISSOLUTION OF THE NORTHWEST AIR POLLUTION AUTHORITY WHEREAS, San Juan County has tendered its withdrawal from the Northwest Air Pollution Authority; and, WHEREAS, the Board of the Northwest Air Pollution Authority has accepted the withdrawal of San Juan County effective January 1, 1983; and, WHEREAS, the only method to effectuate a withdrawal from the Northwest Air Pollution Authority is by dissolution of the Authority pursuant to RCW 70.94.260; and, WHEREAS, the Whatcom County Council believes that it. is in the best interest of the Northwest Air Pollution Authority to permit San Juan County to withdraw if a substitute authority can be created in its place. NOW, THEREFORE., BE IT RESOLVED pursuant to Chapter 238, Laws of the State of. Washington, 1967 (regular session) Whatcom County does hereby approve the dissolution of the Northwest Air Pollution Authority effective January 1, 1983. The Board of the Northwest Air Pollution Authority is hereby.instructed to wind up the affairs of the Authority and to pay all indebtedness thereof as of the effective date of dissolution. The Board is further directed that any surplus funds be paid over to the Cities or Towns compromising the Authority or'to :.tte Counties compromising the Authority in proportion to.their -last contribution as of the effective date of dissolution, January 1, 1983. PROVIDED, HOWEVER, that the foregoing approval is conditioned upon the creation of a new multi- county air pollution control authority as is more specifically described and set forth in Resolution No.82 -53 of this Council.
