RESOLUTION NO. 82 -40 A RESOLUTION ACCEPTING NOR -BELL WASTEWATER FACILITY PLAN ALTERNATE NO. 3 FOR THE CONSTRUCTION OF.A GRAVITY FLOW INTERCEPTOR SEWER LINE FOR PUBLIC ENTITIES INCLUDING NOR - ..BELL NURSING HOME, NORTH BELLINGHAM SCHOOL, WHATCOM COUNTY COMMUNITY COLLEGE, WHATCOM COUNTY LIBRARY AND OTHER STRUC- TURES AND BUILDINGS WITHIN THE COUNTY -OWNED 160 ACRES AT THE INTERSECTION OF SMITH AND NORTHWEST ROADS PLUS 990 RESIDENTIAL CONNECTIONS PLUS 13 ACRES HIGHWAY COMMERCIAL PROPERTY AND AUTHORIZING THE COUNTY EXECUTIVE TO ENTER INTO A CONTRACTUAL AGREEMENT BY AND BETWEEN THE .STATE OF WASHINGTON DEPARTMENT OF ECOLOGY AND WHATCOM COUNTY. WHEREAS, the State of Washington Department of Ecology has deemed it necessary to make certain improvements on the discharge of wastewater for the Nor -Bell Nursing Home; and WHEREAS, the Whatcom County Council is endeavoring to comply with t�e.State of Washington Department of Ecology's request by entering into a contract with Harper -Owes, consulting engineers, to develop a facility plan to provide the necessary sewer service for this facility and other public entities; and WHEREAS, the Whatcom County Council has deemed it appropriate to provide additional sewer service to private property within the designated sewer service area by allowing connections to the sanitary sewer gravity flow line; and WHEREAS, the cost of the private connections will be utilized to assist in financing the County's share of the sewer system and the upgrading of the City of Ferndale sewage treatment plant; NOW, THEREFORE, BE IT RESOLVED as follows: SECTION I. The Whatcom County Council hereby declares its intention to approve the Nor -Bell Wastewater Facility Plan Alternate No. 3, as attached hereto as Exhibit "A ", for the purpose of supplying sewer service to the County and other public entities and residential and commercial properties within the designated North Bellingham k 5 6 7 8 9 10 11 12 13 14 15 16 17 1$ 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Interceptor Service Area. SECTION II. The Whatcom County Council hereby authorizes the County Execu- tive to enter into a contractual agreement by and between the Department of Ecology and Whatcom County whereby the State of Washington will grant the County a minimum of $799,000.00. SECTION III. The Whatcom County Council hereby authorizes the County Execu- tive to enter into Interlocal Cooperation Agreement by and between the City of Ferndale and Whatcom County for the construction, owner ship, operation and maintenance of sewage treatment and disposal facilities for the public Nor -Bell facilities and the North Bellin ham Interceptor Service Area provided that the County Executive shall review and receive approval from the County Council prior to signing of contract on or before August 6, 1982. SECTION IV. The Whatcom County Council hereby authorizes the County Execu- tive to extend the existing; contractual agreement by and between Harper -Owes, consulting project engineers, and Whatcom County for the purpose of preparing environmental impact statement on or before August 15, 1982 and other documents necessary for submittal' to the Boundary Review Board, the State of Washington Department of Ecology and the County Council. Provided further, upon compli- ance with the conditions in Section V. of this resolution, the County Executive is authorized to extend the existing contractual agreement by and between Harper -Owes, consulting project engineers, and Whatcom County for the purpose of completing the design of the Interceptor line and preparation of the engineering report. Section V. Providing, further, that this resolution shall not become effective until or unless minimum guaranteed fees in the amount of $172,500.00 per year, or the equivalent thereof, are received to be applied to the principal and interest for the residential users' share of the Councilmanic bond indebtedness for the first ten years of said project; provided further, the Resolu- tion will not become effective again until the package of commit- ments is reviewed by the Prosecuting Attorney and Executive offices and the County Council. Roehl, Chairman ■ ALTERNATE N0. 3 -This alternative plan would be the enlargement of the Basic Nor -Bell Plan to provide sewerage services along the interceptor route both in the City of Ferndale and in Whatcom County. This alternative would have higher project costs but would also broaden the base for financing the project. � A service area for the interceptor has been proposed which generally covers the area three - quarters of a mile north and one -half mile south of the interceptor route which amounts to approximately 1000 acres (see Figure 2). It is estimated that full develop- ment of this area represents 1700 residential connections and 13 acres of highway commercial property if development occurs in accordance with present land use and zoning. The highway commercial property and 30 residences lie within Ferndale city limits. There are presently 320 residences in the County portion of the service area, some of which may wish to connect to the interceptor. The interceptor would be sized to accommodate wastewater flows from full build -out of the service area. The interceptor would be a 10 -inch gravity sewer along Smith Road connected to a 15 -inch gravity sewer along Barrett Road. The Ferndale treatment plant would be upgraded to provide secondary treatment and expanded to treat wastewater from the five public entities, 990 residential connections, and the 13 acres of highway commercial property along the interceptor. Additional capacity would be provided for 220 connections in Femdale to provide for growth through 1984. The 990 residential connections along the interceptor represents approximately 60 percent of full build -out of the service area. It is expected that commitments for much.of this limited capacity can be obtained from potential users in the near future. Provision of sewerage services beyond the 990 residential connections will be at significantly higher costs due to higher construction costs expected in the future and the lack of state and,/or federal grants to augment local funding . Estimated Project Cost: The construction schedule of the interceptor and treatment plant improvements would be as described for the Basic Nor -Bell Plan.
