A RESOLUTION APPROVING AMENDMENT TO WHATCOM
COUNTY WATER DISTRICT NO. 10's COMPREHENSIVE
PLAN, IN ACCORDANCE WITH THAT DISTRICT'S
RESOLUTION NO. 352, DATED APRIL 7, 1982
IT IS HEREBY RESOLVED:;that:.the 1'Iha.tcom.'Courtty''Coun6il does
approve the amendment to the Comprehensive Plan for Whatcom County
Water District No. 10, as adopted by Whatcom County Water District
No. 10 in Resolution No. 352 dated April 7, 1982.. PROVIDED:
approval is contingent upon Whatcom County Water District No. 10
obtaining necessary approval from the Washington State Department
of Social and Health Services and the Washington State Department
of Ecology.

RESOLUTION NO 35-L
A RESOLUTION of the Board of Commissioners of Water
District No. 10, Whatcom County, Washington,
adopting an'amendment to the comprehensive plan
for a system of sewers of:,the District as previ-
ously adopted; declaring the estimated cost of the
improvements included in such amendment; and
providing the method of distributing such cost and
expense.
WHEREAS, on December 2, 1970, the Board of Commissioners
(hereinafter called the "Board ") of Whatcom County Water District
No. 10, Whatcom County, Washington (hereinafter called` the "Dis-
trict "j, adopted- its Resolution No, 104, providing a comprehen-
sive plan for a system of sewers for•the'District; and
WHEREAS, the Board has recently again investigated all
portions and sections of the District for the purpose of de-
termining the present and future needs of the District in regard
to its-sanitary sewage- collection and disposal system, and has
found and determined that the demand for sanitary sewage and
disposal-service within the area served by the District requires
an amendment to the existing. comprehensive plan for a sewer
system for the District; -
NOW, THEREFORE; BE IT RESOLVED by. the Board of Commissioners
of Water District No. 10, Whatcom County, Washington, as follows:
Section 1,- The comprehensive plan for a system of sewers
for the District shall be amended to provide that the District
shall acquire, construct and install the sewer facilities described
in Exhibit A attached hereto and made a part hereof (hereinafter
"amendment to the plan "),
In carrying out such amendment to the plan, the District
shall acquire and install all manholes, lampholes, wyes, valves
nd other equipment and appurtenances necessary for its proper
operation and shall acquire by purchase, lease or condemnation
all property, both real and personal or any interest therein, and
all rights-of-way, franchises, and easements necessary to carry
out said plan, which is al.l as more particularly set forth in
maps and plans approved by Yoshida Incorporated, consulting
engineers of Seattle, Washington.
It is hereby provided that said amendment to the plan shall
be subject to such changes as to details of pipe size or location
or any other details of said plan as may be authorized by the
Board either prior to or- during the actual course of construction.
The District may proceed with the construction and installa-
tion of the improvements included in amendment to the" plan -as
herein authorized, either alone : or - i.n conjunction with the cons uct
of other facilities of the District,. and in whole; or in successive
parts or- units from-time to time as--may-be found advisable_
Section 2. The estimated cost of the acquisition, construc-
tion and installation of the improvements included in such amendment
to the plan Is hereby declared to be, as near as may be, the sum
of $ 1.00 which shall * be -- provided for out of moneys
accumulated in the, maintenance fund in excess of the requirements
of such fund for payment of operating and maintenance expenses
and redemption or servicing of outstanding -'.obli.gatons of the
District.
Section 3. This amendment to the plan shall be submitted
for approval to an engineer designated by the Whatcom County
Council, to the .Whatcom County Director of- Health, to the Whatcom
County Council,- -and to the 'legislative authority of any affected
city or town; and shall become effective on the date of approval
as provided by law.
