RESOLUTION NO. 2 19
IN THE MATTER OF CREATING WHATCOM
COUNTY ROAD IMPROVEMENT DISTRICT NO. 6
AND ESTABLISHING THE DISTRICT AS THE
BAYVIEW DRIVE ROAD IMPROVEMENT DISTRICT
AND ORDERING..THE IMPROVEMENTS.
WHEREAS, the Whatcom County Council adopted Resolution No.
83 -38 on August 18, 1983 at the regular Council meeting, initiating
the formation of Whatcom County Road Improvement District No. 6,
established the date for a public hearing therefor and provided
for the mailing of ballots regarding such formation to owners of
properties within the proposed road improvement district; and
WHEREAS., a majority of the votes cast were in favor of
the creation of.the road improvement district; and,.
WHEREAS, pursuant to RCW 3.6.88.060 a public hearing on
the formation of Road Improvement District No. 6 was held in the
Whatcom County Council Chambers, Bellingham., Washington,.on
October 6, 1983 and continued until October 20, 1983 at the
regular Council meeting; and,
WHEREAS, after.due consideration., the Council finds
that the plans for improvements for Road Improvement District No. 6
to be feasible.and the benefits to be derived therefrom by the
properties within the proposed Road Improvement District No. 6 woul
exceed the cost and expense of the formation of the district and
the construction of the improvements;.
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. There i-s hereby created the Whatcom County
Road Improvement District No. 6.
2. The nature and territorial.extent.of the
improvements of said district shall consist
of the construction of a bulkhead along
Bayview Drive to Federal, State and.County
standards, all to be located in Point Roberts,
Whatcom County, in portions of .Sections 35
RESOLUTION - 1.
1 and 36, Township 41 North, Range 3 West,.
W.M. and Section 1, Township 40 North,
2 Range 3 West, W.M.
3 3. The boundaries of Road Improvement District No.
6 shall be as set forth by legal description
4 in Exhibit "A" attached hereto and incorporated
herein by reference.

4. That the total estimated cost of the improvement
6 is $213,500. $160,125 shall be provided by
Federal Emergency Management Agency (F.E.M_�A).
.7: $53,375.is estimated for the Road Improvement
District's share.

5.. The method of assessment for the Road Improvement
.9 District's cost.shall be based upon a per lot/
parcel format. All lots and parcels within Road
10' Improvement District No. 6 shall be assessed at
an estimated cost not to exceed $159 per lot or
11 parcel. The preliminary assessment roll has been
filed and recorded with the Clerk of the
12 Council.
13 6. Ballots in favor of the formation of.Road
Improvement District.No..6,.representing $19,954.50
14 of estimated assessments, were received by the
Clerk of the Council. Ballots opposed to the forma -,
15 tion of Road Improvement District No.-6 represent.
$9,063.00 of the.estimated assessments. The
16 County Council's finding on the results of the
balloting . is that the majority of the votes
17 cas*6- were in-favor of the creation of Road
Improvement District No. 6.

Beginning at a point where the southerly right of way line of Roosevelt Road
intersects the line of ordinary high tide of Boundary Bay, said point being 60
feet more or less, south of the International Boundary in Section 35, Township
41 North, Range 3 West, W.M.;
Thence, Westerly along a line 60 feet south of and parallel to the International
Boundary, also referred to as the southerly right of way line of Roosevelt Road,
for a distance of 1355 feet more or less, to a point on the easterly right of
way line of Derby Avenue;
Thence, Southerly along said right of way line for 1160 feet more or less;
Thence, Easterly along a perpendicular line, also referred to as the northerly
