RESOLUTION NO. 83-411
A RESOLUTION IN THE MATTER OF ABANDONMENT
AND DISSOLUTION OF WHATCOM COUNTY SEWER
IMPROVEMENT DISTRICT NO. 1, A SEWER IM-
PROVEMENT DISTRICT ESTABLISHED FOR THE
PURPOSE OF PROVIDING SEWER SERVICE TO THE
RESIDENTS RESIDING IN THE BIRCHWOOD AREA
OF WHATCOM COUNTY
WHEREAS, the County Council did receive a petition for the abandon-
ment of Whatcom County Sewer Improvement District No. 1, a sewer improvement
district established for the purpose of providing sewer service to the resi-
dents residing in the Birchwood area of Whatcom County, an area abutting the
city limits of the City of Bellingham; and
WHEREAS, the City of Bellingham has agreed to provide direct sewer
service to said area; and
WHEREAS, the most appropriate and efficient method of implementing
the direct service is by means of abandonment of Whatcom County Sewer
Improvement District No. 1; and
WHEREAS, a public hearing has been held by the County Council on
September 1, 1983 pursuant to R.C.W. 85.08.540; and
WHEREAS, the County Council has determined that the abandonment of
the district should take place;
NOW, THEREFORE, BE IT RESOLVED by the Council of Whatcom County,
Washington, that Whatcom County Sewer Improvement District No. 1 is hereby
dissolved and said dissolution is conclusive upon all persons except for fraud
or lack of jurisdiction and from this day forward direct sewer service to
residents within the Birchwood area shall be provided by the City of
Bellingham, Washington.
