Board 3 RESOLUTION NO. 83 -41 4 A RESOLUTION IN THE MATTER OF APPLICATION b TO THE SECRETARY OF THE INTERIOR FOR AND 5 SECURING TRANSFER OF REAL PROPERTY OWNED BY THE UNITED STATES, MORE COMMONLY KNOWN 6 AS BLAINE AIR FORCE STATION, TO WHATCOM COUNTY AND GIVING THE PARK DIRECTOR THE 7 AUTHORITY TO PERFORM ALL DUTIES IN THE ACQUISITION AND MAINTENANCE OF SAID PROPERTY 8 9 WHEREAS, certain real property owned by the United States 10 located in the County of Whatcom, State of Washington, has been 11 declared surplus and at the discretion of the General Services 12 Administration, may be assigned to the Secretary of the Interior 13 for disposal for public park or recreation purposes, under the 14 provisions of Section 203 (k) (2) of the Federal Property and 15 Administrative Services Act of 1979 (63 Stat. 387), as amended, 16 and rules and regulations promulgated pursuant thereto, more 17 particularly described as follows: 18 That portion of the Northwest quarter of the Southeast quarter of Section 31, Township 40 North, Range 1 east 19 W.M., Whatcom County, Washington described as follows: Beginning at the southwest corner of said Northwest 20 quarter of the Southeast quarter; thence South 87'46'11" east 622.59 feet along the south line thereof; thence 21 North 01'48132" east 276.99 feet; thence North 66'01118" west 289.22 feet; thence North 87'46111" west 354.75 22 feet; thence South 01'48132" west 384.16 feet to the true point of beginning. Containing 5.17 acres more or less. 23 GSA Control No. D- WASH -.749C (2) 24 Total Acreate of Property: Approximately 5.17 25 Acreage Being Requested: Approximately 5.17 26 and; 27 - WHEREAS, Whatcom County needs and will utilize said property 28 in perpetuity for a public park or recreation area as set forth 29 in its application and in accordance with the requirements of 30 said Act and the rules and regulations promulgated thereunder; 31 32 / RESOLUTION - 1. September 15, 1983 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS: Ca n+ i nn 1 Whatcom County shall make application to the Secretary of the Interior for, and secure the transfer to it, of the above menfionec property for said use upon and subject to such exceptions, reserva- tions, terms, covenants, agreements, conditions and restrictions as the Secretary of the Interior, or his authorized representative, may require in connection with the disposal of said property under said Act and the rules and regulations issued pursuant thereto. Section 2: Whatcom County has legal authority, is willing and is in a position to assume immediate care and maintenance of the property and that Roger A. DeSpain, Director, Whatcom County Park and Recreation Board`be, and he is hereby authorized, for aon behalf of the County of Whatcom, to do and perform any and all acts and things which may be necessary to carry out the foregoing resolution including the preparing, making and filing of plans, applications, reports and other documents, the execution, acceptance, delivery and recordation of agreements, deeds and other instruments per- taining to the transfer of said property, including the filing of copies of the application and the conveyance documents in the records of the governing body, and the payment of any all sums necessary on account of the purchase price thereof or fees or costs :incurred in connection with the transfer of said property for survey, title, searches, recordation or instruments, or other costs identified with the Federal surplus property acquisi- tion; provided, however, that all final applications or contracts shall be subject to the approval of the Whatcom County Council.
