RESOLUTION NO. 83 -38
A RESOLUTION OF INTENTION
IN THE MATTER OF FORMATION OF WHATCOM COUNTY
ROAD IMPROVEMENT DISTRICT NO. 6 FOR IMPROVE-
MENT OF BAYVIEW DRIVE SEAWALL - POINT ROBERTS
BE IT RESOLVED by the Whatcom County Council:
SECTION 1.
The Whatcom County Council has been presented with, and has accepted
a request to initiate formation of a County Road Improvement District for
improvement of Bayview Drive Seawall, located in portions of Secs. 35 & 36,
TWN 41 N, R 3W, W.M. and Sec. "I, TWN.,40 N, R 3 W, W.M.
The nature and territorial extent of the improvements shall be as
follows:
1. Construction of a permanent retaining sea wall along Bayview Drive
to Federal, State and County Standards.
SECTION 3.
The proposed Road Improvement District shall be designated as Whatcom
County Road Improvement District No. 6.
SECTION 4.
The legal description of the boundaries of the proposed Road Improve-
ment District is attached hereto as Exhibit "A ".
SECTION 5.
The total estimated cost of the improvements is $172,000.00, of which
$112,500.00 is estimated for the Federal Emergency Management Agency share,
and $59,500.00 is estimated for the Road Improvement District share.
SECTION 6.
The entire cost and expense of the Road Improvement District share will
be borne by the property within the proposed district. The proportionate
cost per property will be calculated on a per lot basis.at an estimated cost
of $145.00 per lot.

The owners of property in said proposed Road Improvement '
District No. 6 shall be notified to appear at a meeting of the
Whatcom County Council in the Council hearing room on the second
floor of the Whatcom County Courthouse to be held at 7:30 p.m., or
as soon thereafter as possible, on the 6th day of October, 1983,
on the proposed Road Improvement District No. 6.

The County Engineer is directed to submit to the Council at or
prior to the meeting specified in the preceding section, a diagram
or print showing thereon the lots, tracts, and parcels of land and
property which will be specially benefited, and the estimated
amount of the cost and expense to be borne by each lot, tract, or
parcel therein, and also designating thereon all property which is
being purchased under contract from the County.

This Resolution of Intention shall be published in at least
two (2) consecutive issues of a newspaper of gengral circulation
in the County, with the date of the first publication to be at
least fifteen (15) days prior to the date fixed by this resolution
for hearing before the Whatcom County Council.

The County Engineer shall see that notice of adoption of this
Resolution of Intention is given to each owner or reputed owner of
a lot, tract, or parcel of land within the proposed district by
mailing to the owner or reputed owner of the property as shown on
the tax rolls of the County Treasurer at the address shown thereon
at least fifteen (15) days before the date fixed for the public
hearing. The notice shall refer to this resolution and the desig-
nated number of the improvement district, and shall set forth the

nature of the proposed improvement, the total estimated amount of
the cost and expense of such improvement to be borne by the parti-
cular lot, tract or parcel, the date and place of the hearing befor
the Whatcom County Council, and shall contain the directions for
voting upon the formation of the proposed district.
SECTION 11.
The Clerk of the Council shall prepare and mail, together with
the notice above referred to, a ballot for each owner or reputed
owner of any lot, tract, or parcel of land within the proposed
improvement district. The ballot shall contain the following propo
sition:
"Shall Whatcom County Road Improvement District No. 6
be formed ?"

and, in addition, shall contain appropriate spaces for the signa-
tures of the property owners, and a description of their property,
and shall have typed or printed thereon the direction that all,
ballots must be signed to be valid and must be returned to the
Clerk of the Council not later than five (5:00) o'clock p.m. of
a day which shall be one (1) week after the date of the public
hearing.

This notice of adoption of the Resolution of Intention shall
also contain the above directions, and in addition, thereto, shall
state the rules by which the election shall be governed.
