HomeMy WebLinkAboutres1983-036August 2, 1983 Draft 1 INTRODUCED BY: Cole 2 DATE: August 40 1983 3 PROPOSED BY: Cole 4 RESOLUTION NO. 83 -36 5 A RESOLUTION RELATING TO SOLID WASTE DISPOSAL AND DECLARING WHATCOM COUNTY'S 6 INTENT TO COOPERATE WITH THE CITY OF BELLINGHAM AND TO ASSUME DIRECT RESPON- 7 SIBILITY FOR THE COMPLETION OF CERTAIN TASKS MORE PARTICULARLY DESCRIBED HEREIN 8 9 WHEREAS, the Whatcom County Executive and the Bellingham 10 Mayor, together with the Chairpersons of the respective legislative 11 authorities, recently executed a "Statement of Cooperative Effort ", 12 as a preliminary statement regarding future relationships between 13 the City and County with respect to the implementation of a- County- 14 wide Solid Waste Disposal Plan; and 15 WHEREAS, the Whatcom County Council finds that the best 16 interests of the community would be served by the enactment of 17 resolutions of intent by the two legislative bodies setting forth 18 each jurisdiction's respective authority and responsibility for 19 the implementation of a long range solution to both jurisdiction's 20 solid waste disposal needs, 21 NOW, THEREFORE, BE IT RESOLVED BY THE WHATCOM COUNTY COUNCIL: 22 That, BY VIRTUE OF THE City of Bellingham's adoption of 23 Resolution No. 56 -1983 on July 18, 1983 delineating those tasks for 24 which it agrees to assume direct responsibility and implementation 25 authority as set forth immediately below, Whatcom County hereby 26 agrees to assume direct responsibility and implementation authority 27 with regard to the completion of those tasks indicated to be its 28 responsibility. 29 Whatcom County Tasks 30 1. Completion of a waste stream analysis and energy production study. 31 2. Provide for transfer sites where needed in the 32 unincorporated areas. Development of an arrangement for solid waste to be deposited at a county -wide central disposal facility from jurisdictions throughout the county, based upon egLitable charges. 4. Optimize use and capacity of existing land fills as an interim measure. ' City of Bellingham Tasks 1. Identification and acquisition of a centralized site for disposal of solid waste from throughout Whatcom County. 2. The development of plans and specifications for the method of disposal to be utilized. 3. Provide for the construction and operation of an appropriate solid waste disposal system and facility. 4. Whatcom County must give approval to these aspects of the City of Bellingham's final decisions: a. That the site is reasonably accessible to the major population centers of Whatcom County, in consideration of the feasible sites available. b. That the capacity of the disposal facility is adequate to service the likely user population of the County consistent with the Whatcom County Comprehensive Solid Waste Plan. c. That the site and facility is consistent with the land use policies of Whatcom County (if located in an unincorporated area in the County). d. That the fees charged of the various juris- dictions within the County for disposing of waste material at the facility will not exceed the City of Bellingham's actual cost of operation in disposing of said material. The Whatcom County Council's review of the above decisions of the City of Bellingham will be carried out in a timely manner, in order to avoid unnecessary or unreasonable delay. BE IT FURTHER RESOLVED that the Whatcom County Council hereby recognizes the need to assign joint or individual responsibilities for the completion of the following additional tasks: 1. Amendment of -the County Comprehensive Solid Waste Plan so as to be consistent with the type of system and facility to be implemented by the City of Bellingham. 2. Securing of State funding. 3. Development of Recycling programs. RESOLUTION - 2. August 2, 1983 1 8 9 10 11 12 13 1 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 4. The Whatcom County Council hereby agrees to the establish -1 ment of an advisory group composed of the Bellingham Mayor and Whatcom County Executive, together with the President of the Belling City Council and Chairperson of the Whatcom County Council, as'well as the Mayors of all the Whatcom County cities for the purpose of advising the respective jurisdictions with respect to the implemen- tation of the various tasks outlined above. BE IT FURTHER RESOLVED, that the Whatcom County Council agrees Ito review with the Bellingham City Council each task for which it has implementation authority so as to identify potential adverse impacts connected with the implementation of any given proposal. BE IT FURTHER RESOLVED, that the Whatcom County Executive is requested to concur in this resolution on behalf of the execitive branch of county government. BE IT FURTHER RESOLVED, that the City of Bellingham is respect• fully requested to concur in the terms and conditions of this resolution. BE IT FINALLY RESOLVED, that the Washington State Department Hof Ecology is requested to approve the City of Bellingham as lead agency for matched state funding for the solid waste facility and the effectiveness of this resolution is contingent upon such approv PASSED this 18th. day of August 1983.
