RESOLUTION NO. 83 -34
A RESOLUTION RELATING TO THE WHATCOM COUNTY PUBLIC
TRANSPORTATION BENEFIT AREA, ESTABLISHING A GOVERNING
BOARD AND SETTING FORTH CERTAIN CONDITIONS OF ITS
FORMATION
WHEREAS, a Whatcom County Public Transportation Improvement
Conference was convened to investigate the need for and
desirability of forming a Public Transportation Benefit Area
(PTBA) in accordance with Revised Code of Washington 36.57A
and found in favor of such formation by adoption of Resolution
No. 1; and
WHEREAS, the County Council has, by Resolution No. 83 -28,
approved the boundaries of the Public Transportation Benefit
Area; and
WHEREAS, a public hearing has been held on July 12, 1983
in accordance with law, and the Conference has finalized
the boundaries of the PTBA in its Resolution No. 2; and
WHEREAS, the Council hereby finds that the formation of the
Public Transportation Benefit Area, with the boundaries
heretofore set, is desirable and in the best interests of
the people of the City of Bellingham and Whatcom County,
and it is therefore appropriate to adopt a resolution, in
accordance with the provisions of R.C.W. 36.57A.050,
constituting the Public Transportation Benefit Area Authority
and governing body; and
WHEREAS, the Bellingham City Council is adopting a resolution
identical to this in order to form an agreement between the
City and the County on this matter,
NOW, THEREFORE, BE IT RESOLVED as follows:
1. The Public Transportation Benefit Authority is hereby
established for the Whatcom County Public Transportation
Area, consisting of the following members:
a)
The County
Executive;
b)
Two members
of the County
Council, selected by and
serving at
the pleasure of
the County Council;
c)
The Mayor of
the City of Bellingham;
and,
d)
Two memhers.of
the Council
of the City of Bellingham,
selected by
and serving at
the pleasure of the City
Council.
2. The City of Bellingham shall offer the capital assets of
the Bellingham Municipal Transit System to the Authority
at no cost other than the assumption of the outstanding
debts on those assets by the Authority.

3. The City and County Councils jointly agree that, insofar
as is possible within the budgetary constraints upon the
Authority, the City of Bellingham should receive transit
service.comparable to that provided in 1982 by the
Bellingham.Municipal Transit System.
4. This resolution shall take effect upon the adoption of
an identical resolution by the City of Bellingham.
