RESOLUTION NO. 83 -5
A RESOLUTION IN SUPPORT OF AMENDING CHAPTER
70.05 OF THE REVISED CODE OF WASHINGTON
WHEREAS, the Whatcom County Council Public Services
Committee, in consultation with the Bellingham City
Council and the Bellingham /Whatcom County District
Board of Health, is considering the creation of a
public health agency as a department of County govern-
ment; and
WHEREAS, it is contemplated that such a department
would provide health services to the unincorporated
areas of Whatcom County and to the incorporated areas
of Whatcom County through inter -local governmental
agreements; and
WHEREAS, Chapter 70.05 R.C.W. authorizes the creation
of county health departments, but would seemingly
require that the local health officer be appointed
by and be under the administrative direction of the
local legislative body (acting as the local board of
health); and
WHEREAS, such an arrangement would be inconsistent
with the separation of legislative and executive
responsibilities set forth in the home rule charters
of Whatcom County and other counties,
NOW, THEREFORE, IT IS RESOLVED that the Whatcom County Council
joins the Bellingham /Whatcom County District Board of Health in
supporting legislation amending Chapter 70.05 of the Revised
Code of Washington to allow the appointment of local health office
in conformance with county home rule charter provisions governing
the selection of administrative department heads and allow for
their administrative control by the Executive bran-ch.
