A RESOLU`1'ION IN THE MATTER OF LITIGATING THE
DEPARTMENT OF ECOLOGY'S CONTRARY ACTIONS WITH
RESPECT TO SHORELINE PERMITS ISSUED BY THE
COUNCIL TO PETER KIEWIT AND SONS CONSTRUCTION
COMPANY ON MAY 17, 1984
WHEREAS, Whatcom County is interested in rational
and well planned economic development; and
WHEREAS, the Peter Kiewit and Sons Construction Company
offers a unique and logical proposal for our heavy
industry area; and
WHEREAS, the State agencies have opposed both permits,
NOW, THEREFORE, BE IT RESOLVED that the Whatcom County Council
and Prosecuting Attorney shall, on behalf of Whatcom County, join
with the Peter Kiewit and Sons Construction Company in litigating
the Department: of Ecology's actions in the matter of the permits
granted to Kiewit on May 17, 1984 by this Council, provided that
Kiewit carries the principal burden of litigation.
PASSED this 12th clay of July, 1.984.
