(REET) FUNDS AND AUTHORIZING THE COUNTY EXICUTIVE TO PREPARE AND 7 ENTER INTO AN INTERLOCAL IGREEMENT BY AND BETWEEN WHATCOM COUNTY AND THE CITY OF BELLINGHAM DESIGNAT- 8 ING WHATCOM COUNTY AS THE SPONSORING ENTITY FOR COMMUNITY ECONOMIC REVITA IZATION LOAN ANDJ URTHER 9 AUTHORIZING THE. - COUNTY EX CUTIVE TO SUBMIT AN APPLICATION FORA LOW -INT REST LOAN TO..THE COMMUNITY 10 ECONOMIC REVITALIZATION 8 ARD. 11 WHEREAS, Whatcom County has a olicy of facilitating economic deve- 12 I� lopment utilizing goals and strategies.aj� set forth in.the reports of the 13 Economic Futures Task Force (WCCOG, J anurry 1983) and SRI International (WCCOG 14 = and WCCI, October 1983); and 15 WHEREAS, one goal is the attra,tion of growth industries offering 16 C highly -paid employment which will increa;�e the diversity of the County's eco- 17 nomic base; and 18 WHEREAS, the Economic Futures litudy suggests the use of public' 19 financing mechanisms to assist and encou,Fage industries consistent with the 20 County's goals, including assistance wit, development of public infrastructure 21 i necessary for attracting such industries and the SRI study su99ests "targeting) 22 available funds toward completing necessary infrastructure improvements" on 23 specific identified industrial park sited selected because of their location 24 and because they require the least effork to complete; and 25 WHEREAS, the State of Washingtqn has a similar policy of facili- 26 tating economic development with one of 10e tools made available being the 27 low- interest loan program offered by the Community Economic Revitalization 28 Board;.and 29 WHEREAS, Trillium Corporation is planning to construct a minimum 30 20,000 square foot industrial facility I�o house two major manufacturing firms 31 on Kellogg Road, between Woods Road and ,Alen Road in the unincorporated area 32 of Whatcom County with the necessary infl�astructure to service the facility to be constructed on Woods Road between Bakirview Road and Kellogg Road, within ORDINANCE - 1. 1 2 3 4 5 6I 7 81 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1 the city limits of the City of Bellingh� and Kellogg Road to Allen Road in the unincorporated area of Whatcom County, all located in Section 12, Township 38 North, Range 2 East., W.M., on what is commonly known as the Wilder pro- perty and has been identified by the SRI study as a suitable target for publicly- funded infrastructure improvemepts; and WHEREAS, said development will be the first phase of a planned industrial park catering to a rapidly gr,Pwing service and manufacturing industry..of.high technology and..environmirntal sensitivity which would increase the diversity of the County's economic b�se; and WHEREAS, the creation of the punned industrial park will create approximately 300 temporary and permanen,� job opportunities for the citi- zens of Whatcom County; and WHEREAS, the project has been j)etermined to be feasible and can be completed in 1984 with the assistance and cooperation of local govern- mental agencies; NOW, THEREFORE, BE IT RESOLVEDIj 1. The execution of.Whatcom �punty's economic development policy may include sponsorship, and participatigIn in the payback, of CERB loans for infrastructure projects required by I! specific industrial facility, pro- vided that: a) The development will generate a substantial number of new jobs for -the community; b) The type of development is consistent with the County's economic development goals and strategy as articulated in the 1983 reports of the Economic Futures Task Force and SRI Ipternational; c) The developer providep adequate security for that part of the loan which the County does not undertRke directly, in the form of security bond, deed ,of trust, an acceptable letter of credit or other approved • security. 2. The project planned by Tril,lium Corporation for the Wilder pro-1 perty meets the above conditions; 3. The Whatcom County Council hereby authorizes the County Executive to submit to the Community Economic Revitalization Board (CERB), ORDINANCE - 2. I Department of Commerce and Economic Dell.elopment, an application for a low 2 interest loan not to exceed $450,000 tj� provide for an economic development 3 public works needs assessment and for he design, specifications and 4 construction of water line extensions, (water system expansion, sewer line 5 extension, and access roads including qIurbs, gutters, sidewalks, landscaping, 6 drainage and underground lighting. SaIld improvements shall be constructed 7 within the city limits of Bellingham within a portion of Woods Road right -of- a way between- .Bakerview Road and Kellogg Road right -of -way from Woods Road 9 intersection west to Allen Road within Whatcom County. 10 4. It is the intent of the County Council to financially par - 11 tic.ipate in that portion of the improvl ent of Kellogg Road from Woods 12 Road intersection west to Allen..Road bj� utilizing Real Estate Excise Tax 13 (REET) funds. The County's participation will be limited to one -half of 14 the design and construction cost to derielop this portion of Kellogg Road 15 to County standards, but in no event s�all the County's contribution 16 exceed the sum of $75,000. 17 5. The County Executive is hereby authorized to prepare and 18 enter into an interlocal agreement by d between Whatcom County and the 19 City of_Bellingham designating Whatcom County as the sponsoring entity 20 for a Community Economic RevitalizatiogIBoard loan for the purpose of 21 obtaining funds and constructing curbs, gutters, sidewalks, paving, 22 street lighting, drainage, landscaping and water systems within the city 23 limits of the City of Bellingham in accordance with City of Bellingham 24 standards. 25 6. The County Executive is hrreby designated as the-respon- 26 sible official for the County and the girector of Public Works as the 27 alternate responsible official for the purpose of design and construc- 28 tion. 29 7. Trillium Corporation is �p reimburse the County for all 30 costs incurred for engineering consulting services if the project is not 31 funded through the Community Economic R ,pvitalization Board. 32 8. The Public Works Director shall, as a condition to the foregoing, obtain an agreement by and between Whatcom County and the Trillium Corporation providing for Trillium Corporation to pay to the County the County's remaining amount of payments due on the Community RESOLUTION - 3 i 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 Economic Revitalization Board loan for tha� portion of the project finan- cially participated in by the County if sa)d development should be annexed to the City of Bellingham prior to repayment of the Community Economic Revitalization Board's loan.
