5 A RESOLUTION RELINQUISHING A LEASE OF EASEMENT
FOR RIGHTS -OF -WAY FOR WHARF SITE OVER AND
6 ACROSS CERTAIN LAKE WHATCOM SHORELANDS.

8 WHEREAS, the Whatcom County Board of County Commissioners filed and
9 received an easement for rights -of -way for wharf site over certain Lake Whatcom
10 shorelands, hereafter more particularly described, on June 6, 1928 from the
11 State of Washington Department of Public Lands; and

WHEREAS, the Council of Whatcom County has determined that said ease -
12
13. ment is no longer required for public use;
14 NOW, THEREFORE, BE IT RESOLVED THAT: The Whatcom County Council does
15 hereby declare that the easement established in the June 6, 1928 order of the
Department of Public Lands over the wharf site on certain lands on Lake Whatcom
16
17 Shore Lands'is no longer necessary for public use.
BE IT FURTHER RESOLVED THAT: The Whatcom County Council requests that
18
the Department of Natural Resources enter an order vacating and releasing the
19
easement which has been created for the benefit of Whatcom County over the pro -
20
22 perty described as follows:
That portion of Block 1, Lake.Whatcom Shore Lands
22 included within the limits of a strip of shore
land 100 feet in width having 50 feet of such width
23 on each side of the following described center
line: Commencing at a point on the west or shore
24 end of Geneva Wharf from which the corner common to
sections 26, 27, 34 and 35 Township 38 north, range
25 3 east, W.M., bears S 56° 58' W 9 feet, N 37° 52' W
125.10 feet, N 540 12' W-534.82 feet and west
26 796.18 feet and running thence S 560 E to and
across said block 1.

28 BE IT FURTHER RESOLVED THAT: The Whatcom County Council requests the
29 County Executive to forward a copy of this resolution to the State of Washington
30 Department of Natural Resources, Olympia, Washington, Office of Public Lands.
