A RESOLUTION DECLARING THE INTENT OF THE COUNTY COUNCIL
TO SPONSOR A STATE COMMUNITY ECONOMIC REVITALIZATION
BOARD LOAN FOR THE PURPOSE OF FINANCING INFRASTRUCTURE
WITHIN STAGE ONE OF CORDATA MIXED USE BUSINESS PARK TO
FURTHER ECONOMIC DEVELOPMENT WITHIN WHATCOM COUNTY,
AND AUTHORIZING THE COUNTY EXECUTIVE TO SUBMIT AN
APPLICATION FOR A LOW INTEREST LOAN TO THE COMMUNITY
ECONOMIC REVITALIZATION BOARD AND ENTER INTO AN
INTERLOCAL AGREEMENT WITH THE CITY OF BELLINGHAM.
WHEREAS, Whatcom County has a policy of facilitating economic develop-
ment utilizing goals and strategies as set forth in the reports of the Economic
Futures Task Force (WCCOG, January 1983) and SRI International (WCCOG and WCCI,
October 1983); and
WHEREAS, one of the goals is the attraction of growth industries
offering highly -paid employment which will increase the diversity of the
County's economic base; and
WHEREAS, the Economic Futures Study suggests the use of public
financing mechanisms to assist and encourage industries consistent with the
County's goals, including assistance with development of public infrastructure
necessary for attracting such industries and the SRI study suggests "targetin
available funds toward completing necessary infrastructure improvements" on spe
cific identified industrial park sites selected because of their location and
because they require the least effort to complete; and
. WHEREAS, the State of Washington has a similar policy of facilitating
economic development with one of the tools made available being the low - interes
loan program offered by the Community Economic Revitalization Board; and
WHEREAS, The Thillium Corporation has completed Phase I of Stage I of
the Cordata mixed use business park in accordance with the agreement by and bet
ween Whatcom County and the Corporation, and in accordance with the rules and
regulations of the Department of Commerce and Economic Development and the City
of Bellingham interlocal agreement; and
RESOLUTION - 1.

1 WHEREAS, The Trillium Corporation has requested that the County sponsor
2 a Community Economic Revitalization Board loan for the purpose of developing
3 infrastructure within the county rights -of -way of Phase II of Stage I of the
4 Cordata mixed use business park located west of Guide Meridian Road, north of
5 Bakerview Road and south of Kline Road with approximately 7UU feet of the site
6 extending north of Kline Road, and as more particularly defined in Exhibit.A.
7 WHEREAS, said development will be the second phase of Stage I of a
8 planned mixed use business park which will create 815 temporary and permanent
9 job opportunities for the citizens of Whatcom County; and
10 WHEREAS, the project has been determined to be feasible and the
11 infrastructure can be completed in 1986 and the completion and occupancy of the
12 buildings on or by December 31, 1987 with the assistance and cooperation of
13 state and local governmental agencies.
14 NOW, THEREFORE, BE IT RESOLVED, the Council of Whatcom County agrees t
15 sponsor the application of The Trillium Corporation for a State Community
16 Economic Revitalization Board loan and hereby authorizes the County Executive t
17 submit the application to the State Community Economic Revitalization Board for
18 financing of infrastructure in the Cordata mixed use business park in the amoun
19 of $2,584,000.OU for design, engineering and construction of sewer, water,
20 roads, lighting, medians, storm drainage, and other utilities to be constructed
21 within the county rights -of -way of Kellogg and Woods roads in accordance with
22 and as defined on the attached Exhibit A, which is incorporated herein by
23 reference. Provided:
P4 1. The developer will generate a substantial number of new jobs for
P5 the community; and
P6 2. The type of development is consistent with the County economic
27 development goals and strategy as articulated in the 1983 reports of the
28 Economic Futures Task Force and SRI International; and
P9 3. The developer will provide the County with securities in the form
30 of bonds, first trust deeds on properties, or other acceptable securities agree,
31 to by Whatcom County and the City of Bellingham in the amount of 110% of the
32 total loan, including interest; and
RESOLUTION - 2.

1 4. The proposed planned project is in conformance with the County's
2 land use plan; and
3 5. The County receives a statement of intent from the City of
4 Bellingham to provide sewer and water utilities subject only to compliance with
5 all formal requisites of extension of the City's utility service zone and
6 Resolution No. ; and
7 6. For any request for extension of time beyond the date stipulated
8 herein, the developer shall receive prior written approval from the County, the
9 City of Bellingham, and the State Community Economic Revitalization Board.
10 BE IT FURTHER RESOLVED, that the County Executive is hereby designated
11 as the responsible official for the County and authorized to submit to the
12 State Community Economic Revitalization Board, Department of Commerce and
13 Economic Development, an application for a low- interest loan not to exceed
14 $2,584,000.UU, and to enter into an interlocal agreement by and between Whatcom
15 County and the City of Bellingham for the purpose of supplying water and sewer
16 services and for the construction of the facilities within Kellogg Road right -
17 of -way within the city limits between the Guide Meridian and Woods Road and
18 designating Whatcom County as the sponsoring entity for the Community Economic
19 Revitalization Board loan for the purpose of obtaining State Community Economic
20 Revitalization Board funds and the Director of Public Works is hereby designate
21 as the alternate responsible offical for the purpose of design, engineering and
22 construction of the infrastructure as designated and approved on Exhibit A and
23 in accordance with the interlocal agreements by and between the City of
24 Bellingham and Whatcom County.
25 BE IT FURTHER RESOLVED, that the County Executive shall, as a conditio
26 of approval of the foregoing, obtain an agreement by and between Whatcom County
27 The Trillium Corporation and the State Community Economic Revitalization Board
28 concerning the transfer of sponsorship from the County to the City in the event
29 that Cordata Mixed Use Business Park Stage I is annexed by the City prior to
30 repayment of the State Community Economic Revitalization Board loans. Said
31 agreement shall provide, in the event Cordata Mixed Use Business Park Stage I i
32 annexed to the City of Bellingham prior to repayment of the Community Economic

Revitalization Board loans, that the City will accept the securities assigned t
the County from The Trillium Corporation guranteeing payments on the Community
Economic Revitalization Board loans and the City will assume the remaining
balance of payments of the loans due and payable to the State.
