RESOLUTION NO. 85 -49
A RESOLUTION DECLARING THE INTENT OF THE COUNTY
COUNCIL TO SUPPORT ANNEXATION OF A PORTION OF THE
URBAN SERVICE AREA, AS DEFINED IN THE CITY OF
BELLINGHAM URBAN SERVICE AREA ANNEXATION POLICY,
ORDINANCE NO. 9461, AS IT PERTAINS TO DELINEATION
OF NEIGHBORHOOD BOUNDARIES, OF WHICH CORDATA
BUSINESS PARK SITE, LOCATED WEST OF GUIDE
MERIDIAN ROAD, NORTH OF BAKERVIEW ROAD AND
EXTENDING TO APPROXIMATELY 700 FEET NORTH OF
KLINE ROAD, IS A PART.
WHEREAS, Whatcom County has a policy of facilitating economic develop-
ment offering employment and increasing the diversity of the county's economic
base through sponsorship of state Community Economic Revitalization Board loans
and
WHEREAS, the County did sponsor a state Community Economic
Revitalization Board loan for financing the infrastructure within county
rights -of -way in Phase I, Stage I of the Cordata mixed use business park, as
defined in Exhibit A, Schedule 2 -C, which is incorporated herein by reference;
and
WHEREAS, The Trillium Corporation has requested that the County Counci
sponsor an additional application for completion of the infrastructure in Stage
I of the Cordata mixed use business park, as defined in Exhibit A, Schedule 2 -C
WHEREAS, The City of Bellingham has been requested to provide water an
sewer utility services to the Cordata mixed use business.park site as defined c
Exhibit A, Schedule 2 -C, subject to all ordinances and policies of the City of
Bellingham, and other approving agencies for completion of the infrastructure 1
Stage I in the Cordata mixed use business park as defined in Exhibit, A Schedul
2 -C; provided that The Trillium Corporation agrees to execute a no protest
annexation agreement or, at the City's option, to file an annexation petition i
such time as annexation proceedings are initiated; and

WHEREAS, it is anticipated that development of Stage I of Cordata
Business Park site as defined on Exhibit A, Schedule 1 -B, which is incorporated
herein by reference, will occur in two years; and
WHEREAS, the County agrees to support annexation of the Cordata site
upon the following schedule:
1. Annexation of the portion of the Cordata site lying southerl
of the realigned Horton Road at completion of Stage I deve-
lopment plus five years; and
2. Annexation of that portion of the Cordata site lying
northerly of the realigned Horton Road five years after
annexation of the property described in paragraph 1 above;
NOW, THEREFORE, BE IT RESOLVED by the Council of Whatcom County that
the intent of this resolution is consistent with County and City economic deve-
lopment goals and the City's Urban Service Area Annexation Policy, and the
County Council hereby declares that it is the intent of the County to support
annexation of the Cordata mixed use business park site according to the schedul
set forth above, the site being a portion of the Urban Service Area, as defined
in the City of Bellingham Urban Service Area Annexation Policy, as it pertains
to delineation of neighborhood boundaries, of which Cordata Business Park is a
part; provided, annexation shall be in accordance with and as defined in the
City of Bellingham Urban Service Area Annexation Policy, Ordinance No. 9461, as
it pertains to delination of neighborhood boundaries; and provided that the Ci
agrees to assume the remaining unpaid balance of the Community Economic
Revitalization Board loans; and
BE IT FURTHER RESOLVED, that this resolution shall become effective
upon receipt from the City of Bellingham of a resolution stating the City's
intent to extend sewer and water utilities to the Cordata development, subject
only to compliance with all formal requisites of extension of the City's
Utilities Service Zone and the Annexation Schedule included in this resolution.
BE IT FINALLY RESOLVED that this resolution shall be imme-
diately transmitted to the President and 'all members of the Bellin
ham City Council and the Mayor of the City of Bellingham.
