WHEREAS, RCW 84.64.270 allows the County to sell real estate acquired by tax foreclosures where it is found to be in the best interests of Whatcom County to sell the same; and WHEREAS, said statute allows the legislative authority to combine any or all of several lots and tracts in one or more units if said legislative authority feels it is in the County's best interests; and WHEREAS, Whatcom County Council does deem it to be in the County's best interests to combine several lots which the County has title to as a result of tax foreclosure in Sudden Valley; and WHEREAS, the Whatcom County Council does deem it in the best interests of the County to sell these lots; and WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve from the sale, coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources unless the Council finds that it is in the best interests to transfer these; and WHEREAS, the Whatcom County Council does deem it in the best interests of the County not to reserve these mineral rights, but rather to transfer them with the sale; and WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said unit of property and to determine whether or not a contract will be allowed or if it will be a RESOLUTION -1 1 2 3 4 5 6 7 8 9 10 11 12 13. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 cash price; and WHEREAS, the Whatcom County Council deems that the price of $31,806.26 is the price for the said lots but that for the County to accept a contract on this price would not be in the County's best interests and the Council would require that this amount be paid in cash; NOW, THEREFORE, BE IT RESOLVED that it is in the best interests of the County to sell Sudden Valley, Division 1, Lot 12; Sudden Valley, Division 3, Lot 67; Sudden Valley, Division 4, Lot 104; Sudden Valley, Division 4, Lot 131; Sudden Valley, Division 5, Lot 7; Sudden Valley, Division 6, Lot 134; Sudden Valley, Division 8, Lot 57; Sudden Valley, Division 8, Lot 70; Sudden Valley, Division 9, Lot 86; Sudden Valley, Division 9, Lot 140; Sudden Valley, Division 9, Lot 159; Sudden Valley, Division 11, Lot 182; Sudden Valley, Division 14, Lot 8; Sudden Valley, Division 14, Lot 45; Sudden Valley, Division 14, Lot 87; Sudden Valley, Division 14, Lot 107; Sudden Valley, Division 16, Lot 14; Sudden Valley, Division 16, Lot 21; Sudden Valley, Division 16, Lot 39; Sudden Valley, Division 16, Lot 108; Sudden Valley, Division 16,,Lot 120; Sudden Valley, Division 22, Lot 1; Sudden Valley, Division 22, Lot 7; Sudden Valley, Division 22, Lot 133; Sudden Valley, Division 24, Lot 112; Sudden Valley, Division 24, Lot 163; Sudden Valley, Division 24, Lot 165; Sudden Valley, Division 24, Lot 184; Sudden Valley, Division 25, Lot 67; Sudden Valley, Division 25, Lot 86; Sudden Valley, Division 25, Lot 111; Sudden Valley, Division 25, Lot 125; Sudden Valley, Division 28, Lot 74; Sudden Valley, Division 28, Lot 75; Sudden Valley, Division 28, Lot 76; Sudden Valley, Division 30', Lot 89; all for a total bid price of $31,806.26 plus costs and further in this sale transferring to the owner all coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources on or in said lands and the right to mine for RESOLUTION -2 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 and remove the same; BE IT FURTHER RESOLVED that this order shall be subject to the certification of the County Treasurer since several lots and tracts of land are combined in one unit. Once the Treasurer shall certify that the price set in this Resolution is the actual amount of taxes which are owed to the County as provided for in RCW 86.64.270, he shall direct the sale take place; BE IT FURTHER RESOLVED that said price shall not be allowed under contract and shall be paid in either cash, certified check, or money order to the Whatcom County Treasurer at the time of sale; BE IT FURTHER RESOLVED that the Whatcom County Treasurer is hereby directed to sell such property at not less than the certified price and said sale shall take place in. accordance with the duties as established in RCW 84.64.270.
