RESOLUTION ADOPTING POINT ROBERTS WATER
DISTRICT NO. 4'S AMENDMENTS TO THEIR
COMPREHENSIVE PLAN
WHEREAS, at Point Roberts Water District No. 4's regular
meeting on March 28, 1985, they adopted an amendment to their
comprehensive plan which is to provide for the issuance of some
revenue bonds in order that the District might develop a proposed
water reservoir and water source agreement with the Greater j
Vancouver Regional District; and !�
WHEREAS, the Whatcom County Council has reviewed the compre-
hensive plan amendments as drafted in the Water District No. 4's
resolution no. 427; and
WHEREAS, the Whatcom County Council finds that the amendments
proposed by Point Roberts Water District No. 4 are in the best i
interests of the public and the constituents of Water District
No. 4;,. and
WHEREAS, Point Roberts Water District No. 4's resolution
no. 427 is incorporated by reference into this resolution as if

NOW, THEREFORE, IT IS HEREBY RESOLVED that resolution no. 427 j

as proposed by Point Roberts Water District No. 4 shall be approved
BE IT FURTHER RESOLVED that unless specifically amended by i
resolution no. 427, all of the terms and conditions Point Roberts
Water District No. 4's Comprehensive Plan shall remain in full I

force and effect.

WATER DISTRICT NO. 4
WHATCOM COUNTY, WASHINGTON
RESOLUTION NO. 427
A RESOLUTION of the Board of Water Commissioners of Water
District No. 4, Whatcom County, Washington, adopting a
plan for providing for additions and betterments to the
original comprehensive plan for a system of water supply
and distribution for the District; providing for the
method of distributing the cost and expense of the plan
of addition and betterments and providing that the costs
and expenses shall be paid from) the proceeds of sale of
revenue bonds of the district payable out of water
service charges and assessments to be levied in one or
more utility local improvement districts authorized to
be created.
WHEREAS, on May 6, 1959, the Board of Water Commissioners of
Water District No. 4, Whatcom County, Washington (hereinafter
referred to as the "District "), adopted its Resolution No. 8
containing a general comprehensive plan for a system of water
supply and distribution for the District and authorized the
issuance and sale of water revenue bonds of the District for the
purpose of carrying out the comprehensive plan in the sum not to
exceed $3,000,000; and
WHEREAS, at a special election held in the District on
August 28, 1959, pursuant to law and Resolution No. 8 of the
District, the voters of the District authorized the issuance of
the above - referenced water revenue bonds in the manner required by
law; and
WHEREAS, the comprehensive plan for a system of water supply
and distribution for the District has been supplemented and added
to at various times thereafter by the adoption of plans of addi-
tions and betterments to that comprehensive plan; and
WHEREAS, the District heretofore has authorized and issued
water revenue bonds for the purpose of.providing funds to pay the
cost of carrying out the additions and betterments to that compre-
hensive plan, and in the manner required by law; and
WHEREAS, since the adoption of the original comprehensive
plan, the Water Commissioners have been advised and have found
that the existing water supply sources of the District are inade-
quate to serve safely the present and future needs of the District
and its customers, and this Board finds that the acquisition,
construction and installation of the water facilities hereinafter
described are necessary to provide for the needs of that area and
that the comprehensive plan heretofore adopted and amended should
be further amended to authorize the acquisition, construction and
installation of the water facilities hereinafter described;
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF WATER COMMIS-
SIONERS OF WATER DISTRICT NO. 4, WHATCOM COUNTY, WASHINGTON, as
follows:
Section 1. The following plan of additions to and better-
ments of the original comprehensive plan as set forth in Resolu-
tion No. 8 is hereby adopted.
a. The District shall construct a reservoir and pump
station in Point Roberts to store and distribute water from the
Greater Vancouver Regional District, British Columbia, as
described in Exhibit A attached hereto, which Exhibit is by this
reference thereto fully incorporated herein as if fully set forth
in this paragraph.
b. In carrying out such plan of additions and better-
ments, the District shall acquire, construct and install all
auxiliary valves, fittings, equipment and appurtenances necessary
for the installation and operation of such improvements, and shall
acquire by purchase, condemnation, gift or grant all property,
both real and personal, or any interest therein, and all ease-
ments, rights -of -way and franchises which may be found necessary

to carry out such plan of additions and betterments, details of
which are more particularly set forth in maps and plans prepared
by Hammond, Collier & Wade- Livingstone Associates, Inc. of
Seattle, Washington, consulting engineers for the District.
C. The additions and betterments described in this
resolution shall be subject to such changes as to details of such
plans as shall be authorized by this Board either before or during
the course of construction.
d. The District may proceed with the construction and
installation of the additions and betterments herein authorized,
either alone or in conjunction with the construction of other
facilities of the District, and in whole, or in successive parts
or units from time to time as may be found advisable.
Section 2. The estimated cost of the acquisition, construc-
tion, and installation of said additions and betterments is hereby
found and declared to be as near as may be, the sum of $4,1.00,000.
To provide the funds necessary to pay the costs of such
additions and betterments, the issuance and sale of revenue bonds .
of the District in the total principal sum of $4,300,000 is hereby
authorized.
It is contemplated that the cost of carrying out the addi-
tions and betterments to the comprehensive plan as herein set
forth shall be paid from the proceeds of water revenue bonds of
the District in the principal sum of not to eMdeed $4,300,000,
provided that the authorization of such bonds shall not prevent
the Board of Water Commissioners from accepting available state or
federal grants and applying the same to pay a portion of such
costs.
Said bonds shall bear interest at a rate not to exceed the
maximum rate permitted at the time said bonds are sold and shall

be payable in various amounts and at times not to .exceed thirty
(30) years from date of issue. Both principal of and interest on
said bonds shall be paid from the revenue of the water system (or
mutual water and sewer system should one be created) and all
additions and improvements thereto, and from assessments, if any,
as hereinafter provided. The exact date, form, terms and.maturi-
ties of said bonds shall be as hereafter fixed by resolution of
the Board of Water Commissioners.
Section 3. It is contemplated that all of the land within
the District which will be specially benefited by the construction
and installation of the improvements generally described in this
resolution may be included in one or more utility local improve-
ment districts, and that assessments be levied in such district or
districts in an amount to be fixed by the Board of Water Commis-
sioners for each such district, but not to exceed a total of
$3,200,000 for all such improvements and' within the special
benefits received. All of the assessments as levied in such
utility local improvement district or districts shall be collected
and paid into a revenue. bond redemption fund and shall be pledged
for the payment of the principal of and interest on water revenue
bonds of the District.
ADOPTED by the Board of Water Commissioners of Water District
No. 4, Whatcom County, Washington, at its req_ meeting on Thursday
the 28 day of March, 1985.

keeper of the records of the Board of Water Commissioners (herein
called the "Board ") DO HEREBY CERTIFY:
1. That the attached is a true and correct copy of Resolu-
tion No. 427 (herein called the "Resolution ") of the District, as
finally adopted. at a meeting of the Board held on the 28 day of
March, 1985, and duly recorded in my office.
2. That said meeting was duly convened and held in all
respects in accordance with law, and to the extent required by
law, due and proper notice of such meeting was given; that a
quorum was present throughout -the meeting and a legally sufficient
number of members of the Board voted in the proper manner for the
adoption of the Resolution; that all other requirements and
proceedings incident to the proper adoption of the Resolution have
been duly fulfilled, carried out and otherwise observed, and that
I am authorized to execute this certificate.
