BAKER RIM DIVISION ONE, Block 1, Lot 26, and Block 6, Lot 39, recorded as Mt. Baker Rim Division One, Volume II, Pages 74 -76 as being surplus and allowing them to be sold; and, WHEREAS, as a result of said resolution, the property was listed as being surplus and ready to be sold; and, WHEREAS, the resolution was silent as to the reservation or transfer of coal, oil, gas, gravel, minerals, ores, fossils, timber or other natural resource rights; and, WHEREAS, since it was silent, the presumption is in both Whatcom County Code as well as state law that the mineral rights are reserved; and, WHEREAS, the Whatcom County Council did not intend to reserve the mineral rights on this piece of property; and, WHEREAS, it is in the public's best interest that Resolution No. 84 -26 be amended to reflect the transfer of these mineral rights rather than the reservation of these mineral rights; NOW, THEREFORE, BE IT RESOLVED that Resolution No. 84 -26 shall be amended so as to transfer to the purchaser of said lot the coal, oil, gas, gravel, minerals, ores, fossils, timber and other natural resources and their right to mine and remove the same. In all other respects, Resolution No. 84 -26 shall remain in full force and effect.
