RESOLUTION NO. 85 -13
A RESOLUTION AMENDING RESOLUTION
NO. 85 -9 TO SELL REAL PROPERTY
ACQUIRED BY COUNTY ON TAX FORECLOSURE
WHEREAS, on the 7th day of February, 1985, the Whatcom
County Council adopted Resolution No. 85 -9 which established
the sales price for County -owned lots in Sudden Valley; and,
WHEREAS, at the time of original adoption, the Council
reserved the mineral rights in accordance with State law;
and,
WHEREAS, Whatcom County Ordinance No. 2.72.020 also
requires the reservation of mineral rights unless the Council
expressly consents to selling them; and,
WHEREAS, since the adoption of Resolution No. 85 -9, it
has come to the Council's attention that the sales will not occur
if the Council retains the mineral rights; and,
WHEREAS, these lots are for residential homes and the
(public interest would be better served by selling these lots,
transferring the mineral rights rather than not selling these
lots at all; and,
WHEREAS, Whatcom County Code 2.72.090 does allow the
Council to sell the mineral rights if it specifically consents to
transferring them; and,
WHEREAS, the Council deems it in the best interest of the
public to transfer these mineral rights; therefore, the public in-
terest would be better served by amending Resolution No. 85 -9
and allowing the transfer of the mineral rights to occur;
NOW, THEREFORE, BE IT RESOLVED THAT Resolution No. 85 -9
shall be amended as follows:

It is in the best interest of the County to sell Sudden
Valley, Division 14, Lot 84 for $894.70 cash, plus costs; reserving

timber-er- ether- reseurees- en- er -ii3- said - lands- and -the- right -te --
mine -fer- and- remeve -the- same -te -the- County; in transferring all
interest of the County to the Purchaser including mineral rights;
and,
BE IT FURTHER RESOLVED that it is in the best interest
of the County to sell Sudden Valley, Division 29, Lot 73 for
$669.10 cash, plus costs; reserving -te- the- 8eunty- the- eealT -eilT
gas; - gravel-- mineralsT- eree-- fessils-- timber -er- ether- reseurees
en -er -in -said- lands- and- the- right -te- mine -fer- and- remeve -the -same
te- the - County; in transferring all interest of the County to the
Purchaser including mineral rights; and,
BE IT FURTHER RESOLVED that it is in the best interest of
the County to sell Sudden Valley, Division 22, Lot 204 for
$1,419.28 cash, plus costs; reserving -te- the- Ceuigty- the -eeal,

BE IT FURTHER RESOLVED that the Whatcom County Treasurer
