RESOLUTION NO. 86 -61
A RESOLUTION RESCINDING RESOLUTION NO. 86 -11,
A RESOLUTION TO CLOSE CEDARVILLE LANDFILL SITE.
WHEREAS, Whatcom County has the responsibility for the protection of
the public health, safety and disposal of solid waste that has accumulated
within Whatcom County; and
WHEREAS, Whatcom County has an existing landfill site commonly known as
Cedarville; and
WHEREAS, THE Whatcom County Council has received and is presently
reviewing the Revised Comprehensive Solid Waste Plan; and
WHEREAS, Resolution No. 86 -11 requires closure of the Cedarville land-
fill site by January 1, 1987; and
WHEREAS, there presently exists an emergency due to the temporary clo-
sure of one of the two solid waste incinerating sites within Whatcom County;
WHEREAS, the other incinerator site is not presently equipped to pro-
cess all the putrescible garbage within Whatcom County;
NOW, THEREFORE BE IT RESOLVED that:
1. The Whatcom County Council deems it necessary to extend operation
of the Cedarville landfill site for receiving putrescible garbage until March
31, 1987, for receiving putrescible garbage not to exceed 25,000 tons per year
in emergency situations only after March 31, 1987, and to receive unburnables
and construction debris; and
2. The Whatcom County administration, Department of Public Works, is
hereby instructed to file an application with the Bellingham & Whatcom County
Health District Board for an extension of the present operating;, permit, Permit
No. 37003, through March 31, 1987; and
3. The Department of Public Works is instructed to file the necessa
application and documents with the Department of Public Health, Bellingham &
Whatcom County Health District Board, and the State Department of Ecology for
the continuous operating of the Cedarville landfill-site for the purpose of
receiving unburnables and construction debris and for emergency use for
receiving putrescible garbage not to exceed 25,000 tons per year without the
approval of the Whatcom County Council and other local and state agencies; and
4. The Whatcom County administration is directed to request extensi
of the State Department of Ecology grant for leachate engineering, design and
installation at Cedarville and the Ferndale treatment plant site; and

5. The Director of Public Works is requested to seek an extension of
a proposed agreement with the City of Ferndale, a agreement for construction,
operation and maintenance of pre- treatment facilities for the pre- treatment and
disposal of leachate at the Ferndale wastewater treatment plant; and
6. The administration is to present to the Whatcom County Council, on
or before January 31, 1987, an ordinance providing for an agreement by and bet-
ween Whatcom County and Thermal Reduction Company permitting the collection of a
pass - through fee not to exceed 10% per can and requiring that contract haulers;
private companies or individuals make payment of the fee upon disposal of the
solid waste materials at Thermal Reduction Company's processing plant at 1524
Slater Road; and
7. The Whatcom County Council shall consider approval of the Revised
Comprehensive Solid Waste Plan on or before January 31, 1987; and
8. The administration is instructed to present to the Council, on or
before January 8, 1987, the engineering and construction cost and time schedule
for the installation of a leachate system at Cedarville landfill site and the
pre- treatment facility at the City of Ferndale treatment plant site.

BE IT FURTHER RESOLVED that Resolution No. 86 -11 is hereby rescinded.
