5 A RESOLUTION TO SELL PROPERTY
ACQUIRED BY COUNTY ON TAX
6 FORECLOSURE

WHEREAS, RCW 84.64.270 allows the County to sell real estate
8
acquired by tax foreclosures where it is found to be in the best
9
interests of Whatcom County to sell the same; and,
10
WHEREAS, Whatcom County Council does deem it to be in the
11
County's best interest to sell some lots in Sudden Valley
12
Subdivision which have been received through tax foreclosure,
13.
specifically; Lot 68, Divison 8; Lot 70, Division 8; Lot 56
14
Division 9; Lot 95, Division 9; Lot 219, Division 24; and,
15
WHEREAS, the Whatcom County Code as well as the state law
16
allows the County to reserve from the sale, coal, oil, gas,
17
gravel, minerals, ores, fossils, timber or other resources if the
18
Council finds that it is in the best interest to reserve these;
19
and,
20
WHEREAS, the Whatcom County Council does deem it in the best
21
interest of the County not to reserve these mineral rights, but
22
rather to transfer them with the sale; and,
23
WHEREAS, RCW 84.64 requires the Council to establish the
24
minimum price for said unit of property and to determine whether
25
or not a contract will be allowed or if it will be a cash price;
26
and,
27
NOW, THEREFORE, BE IT RESOLVED that it is in the best
28
interest of the County to sell Lot 68, Division 8 of Sudden
29
Valley Subdivision for the minimum price of $835.00 plus costs
30
and further in this sale transferring to the owner all coal, oil,

2 gas, gravel, minerals, ores, fossils, timber or other resources on
3 or in said lands and the right to mine for and remove the same in
4 conformity with zoning regulations in force and effect;
5 BE IT FURTHER RESOLVED that it is in the best interest of
6 the County to sell Lot 70, Division 8 of Sudden Valley Subdivision
7 for the minimum price of $913.73 plus costs and further in this
8 sale transferring to the owner all coal, oil, gas, gravel,
9 minerals, ores, fossils, timber or other resources on or in said
10 lands and the right to mine for and remove the same in conformity
11 with zoning regulations in force and effect;
12 BE IT FURTHER RESOLVED that it is in the best interest of
13 the County to sell Lot 56, Division 9 of Sudden Valley Subdivision
14 for the minimum price of $856.66 plus costs and further in this
15 sale transferring to the owner all coal, oil, gas, gravel,
16 minerals, ores, fossils, timber or other resources on or in said
17 lands and the right to mine for and remove the same in conformity
18 with zoning regulations in force and effect;
19 BE IT FURTHER RESOLVED that it is in the best interest of
20 the County to sell Lot 95, Division 9 of Sudden Valley Subdivision
21 for the minimum price of $879.38 plus costs and further in this
22 sale transferring to the owner all coal, oil, gas, gravel,)
23 minerals, ores, fossils, timber or other resources on or in said
24 lands and the right to mine for and remove the same in conformity
25 with zoning regulations in force and effect;
26 BE IT FURTHER RESOLVED that it is in the best interest of
27 the County to sell Lot 219, Division 24 of Sudden Valley
28 Subdivision for the minimum price of $899.79 plus costs and
29 further in this sale transferring to the owner all coal, oil, gas,
30 gravel, minerals, ores, fossils, timber or other resources on or
31 in said lands and the right to mine for and remove the same in
32 conformity with zoning regulations in force and effect;

2 BE IT FURTHER RESOLVED that this sale shall. be subject to
3 the certification of the County Treasurer. Once the Treasurer
4 shall certify that the price set in this Resolution is the actual
5 amount of taxes which are owed to the County as provided for in
6 RCW 86.64.270, he shall direct the sale to take place;
7 BE IT FURTHER RESOLVED that said price shall not be allowed
8 under contract and shall be paid in either cash, certified check,
9 or money order to the Whatcom County Treasurer at the time of
10 sale;
11 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is
12 hereby directed to sell such property at not less than a certi-
13. fied price and said sale shall take place in accordance with the
14 duties as established in RCW 84.64.270.
