HomeMy WebLinkAboutres1986-032I 1 2 3 4 5 6 7 8 9 10 11 12 13. 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 ISELLRES.686 INTRODUCED BY: Johnson PROPOSED BY: County Executive DATE: 6 -19 -86 RESOLUTION NO. 86 -32 A RESOLUTION TO SELL PROPERTY ACQUIRED BY COUNTY ON TAX FORECLOSURE WHEREAS, RCW 84.64.270 allows the County to sell real estate acquired by tax foreclosures where it is found to be in the best interests of Whatcom County to sell the same; and, WHEREAS, Whatcom County Council does deem it to be in the County's best interest to sell a lot in Sudden Valley Subdivision which has been received through tax foreclosure; and, WHEREAS, the Whatcom County Code as well as the state law allows the County to reserve from the sale, coal, oil, gas, gravel, minerals, ores, fossils, timber or other resources if the Council finds that it is in the best interest to reserve these; and, WHEREAS, the Whatcom County Council does deem it in the best interest of the County not to reserve these mineral rights, but rather to transfer them with the sale; and, WHEREAS, RCW 84.64 requires the Council to establish the minimum price for said unit of property and to determine whether or not a contract will be allowed or if it will be a cash-price; and, WHEREAS, the Whatcom County Council deems that the price of $902.68 is the minimum price for said lot and that it is low enough not to accept a contract on this price but would be in the County's best interest and the Council would require that this amount be paid in cash; NOW, THEREFORE, BE IT RESOLVED that it is in the best interest of the County to sell Lot 340, Division 22 of Sudden RESOLUTION - 1 Valley Subdivision for the minimum price of $902.68 plus costs 1 and further in this sale transferring to the owner all coal, oil, 2 gas, gravel, minerals, ores, fossils, timber or other resources on 3 or in said lands and the right to mine for and remove the same in 4 conformity with zoning regulations in force and effect; 5 BE IT FURTHER RESOLVED that this sale shall be subject to 6 the certification of the County Treasurer. Once the Treasurer 7 shall certify that the price set in this Resolution is the actual 8 amount of taxes which are owed to the County as provided for in 9 RCW 86.64.270, he shall direct the sale to take place; 10 BE IT FURTHER RESOLVED that said price shall not be allowed 11 under contract and shall be paid in either cash, certified check, 12 or money order to the Whatcom County Treasurer at the time of 13. sale; 14 BE IT FURTHER RESOLVED that the Whatcom County Treasurer is 15 hereby directed to sell such property at not less than a certi- 16 fied price and said sale shall take place in accordance with the 17 duties as established in RCW 84.64.270. 18 DATED this 19th day of June 1986. 19 WHATCOM COUNTY C NCIL 20 ,-.
